The Borough Administrator or his designated
municipal official or officer will be authorized to request a criminal
history record background check of any person for an official governmental
purpose, including, but not limited to, employment, licensing and
the procurement of services.
When requested by the authorized designated
municipal official any person seeking employment, a license or the
right to perform services for the Borough of Spring Lake shall submit
to the Borough Administrator a copy of his or her fingerprints in
accordance with applicable state, and federal laws, rules and regulations.
The records, which the designated municipal
official is authorized to request and receive, shall be the criminal
history record information from the Federal Bureau of Investigation,
Identification Section, and, if appropriate, the Division of State
Police, Bureau of Identification.
In order to obtain the criminal history record
information the designated municipal official shall submit the required
fee, fingerprint data and request to State Bureau of Identification.
The State Bureau of Identification shall receive all criminal history
record information from the Federal Bureau of Investigation and shall
disseminate that information to the designated municipal official.
The requesting official shall follow any rules or regulations which
might be promulgated by the Attorney General of the State of New Jersey
pursuant to N.J.S.A. 52:14B-1 et seq.
The authorized municipal official or officer
is authorized to exchange fingerprint data with and receive criminal
history record information from the State Bureau of Identification
in the Division of State Police and the Federal Bureau of Investigation.
Any person, 18 years of age or older, at the
time of commencement of participation in any youth activity, regardless
of the capacity (whether as a volunteer or employee), for any program
that is organized by the Borough of Spring Lake or any Spring Lake-based
organization that utilizes Borough facilities must undergo a mandatory
background record check.
Any person who has undergone a record check
in other than the program that is utilized by the Borough may request
enrollment into the Borough plan so long as it is within six months
from the date of the application in a comparable background record
check program, provided that it meets the threshold standards of the
program utilized by the Borough of Spring Lake.
A person whose primary residence does not change
must renew his or her enrollment in the background record check program
every four years if the person wishes to continue as a volunteer or
employee with the youth program within the Borough. Any person who
changes his or her residence must undergo the full, mandatory record
check in order to be re-qualified.
Any celebrity guests will be allowed to participate
in programs within the Borough so long as they are under the supervision
of an approved record-check participant. Additionally, this article
does not apply to volunteers and employees of teams and/or organizations
that are not based in the Borough of Spring Lake.
The Spring Lake Chief of Police or his designated
representative shall act as the program coordinator and work with
the Borough Recreation Commission or any other organization in administering
this program.
Appeal from any decision to decline an applicant
from participation in any activities covered by this article will
be handled by the Borough Coordinator. The Borough Coordinator, at
his discretion, may establish a review panel to review and decide
any appeals.
