Authorization is given to issue no more than two separate licenses to operate horse-drawn tours on the public streets in the Borough.
The aforesaid licenses may be issued to a person, firm or corporation. However, only one license shall be issued to each person, firm or corporation or to a firm or corporation having the same or similar ownership interests.
In order to obtain an aforesaid license, the applicant must submit an application to the Borough Clerk of the Borough of Spring Lake on the proper form. Such application must list the tour route or routes, the times of operation, the rates to be charged to customers and such other information as may be deemed necessary.
The fee for the issuance of a license shall be the sum of $100 which shall be for the period commencing on May 1 of each year and terminating on November 1 of each year. The charge for the renewal of a license shall be the sum of $100 and such renewal fee shall be accompanied by a renewal application form.
The license fee of $100 shall permit the operation of one horse-drawn vehicle. Any additional horse-drawn vehicles shall be charged the sum of $50 each with a limit of three vehicles for any one operator.
The rates to be charged customers for the horse-drawn tours shall be prominently displayed on the vehicle or vehicles.
A license shall not be issued until such time as the applicant provides a certificate of insurance naming the Borough of Spring Lake as a named insured in a policy having a $1,000,000 combined single limit or in a policy providing for $1,000,000 coverage for bodily injury and $250,000 coverage for property damage. In addition, the applicant shall execute an indemnification agreement with the Borough of Spring Lake.
The license shall be issued by a duly adopted resolution of the Mayor and Council of the Borough of Spring Lake after the submission of a complete application, payment of the fee, furnishing of the proper insurance certificate and execution of an indemnification agreement with the Borough of Spring Lake.
The right is reserved to the Borough of Spring Lake to adopt by resolution such further reasonable rules and regulations as may be deemed necessary for the safe operation of such horse-drawn vehicles.
Every person, firm, association, organization or corporation violating any provisions of this chapter shall, upon conviction, be liable to the penalty stated in Chapter 1, Article II, General Penalty.
