The Greater Spring Lake Chamber of Commerce wishes to construct
and to donate a gazebo to the Borough of Spring Lake for the use of
the residents of the area served by the Greater Spring Lake Chamber
of Commerce, their guests and visitors to Spring Lake; and the Borough
of Spring Lake is willing to accept this gift of a gazebo and upon
completion and acceptance thereof, the Borough of Spring Lake agrees
to maintain and to repair the gazebo and to adopt reasonable rules
and regulations for the use thereof so as to inure to the mutual benefit
of the municipality and to the persons who will use and enjoy the
gazebo in future years.
The offer of the Greater Spring Lake Chamber of Commerce to
construct a building known as a "Gazebo in Potter Park" at the sole
cost and expense of the Greater Spring Lake Chamber of Commerce is
accepted by the Borough of Spring Lake. The gazebo shall be built
in accordance with plans and specifications prepared by Richard B.
Graham, Jr., Architect, Sea Girt, New Jersey.
The Greater Spring Lake Chamber of Commerce shall apply for
and obtain a building permit for the construction thereof. Upon issuance
of a certificate of occupancy by the Borough of Spring Lake, it shall
be deemed that the gazebo has been accepted by the Borough of Spring
Lake. Upon acceptance thereof, the Borough of Spring Lake shall be
responsible solely for the maintenance and repair of the gazebo.
The Borough of Spring Lake is permitted to adopt by resolution
reasonable rules and regulations for the use of the gazebo. In adopting
these rules and regulations, the primary consideration shall be that
the gazebo shall be used for the quiet enjoyment and benefit of all
persons and, in particular, by the residents, guests and visitors
of the area served by the Greater Spring Lake Chamber of Commerce.
The Mayor and Council are authorized to adopt future resolutions,
if deemed necessary, for the construction, maintenance and repair
of the gazebo.
Every person, firm, association, organization or corporation violating any provisions of this article or any regulations adopted pursuant thereto shall, upon conviction, be liable to the penalty stated in Chapter
1, Article
II, General Penalty.
