It shall be unlawful for any person to place
or display upon any sidewalk in the Borough of Wilkinsburg any goods,
wares, merchandise or material. Goods, wares, merchandise and/or material
may be placed upon the sidewalk while being delivered to or removed
from the premises abutting such sidewalk, but then only for so long
as necessary for loading or unloading, as the case may be, and in
no case for longer than 1 1/2 hours, and provided that the sidewalk
be kept open sufficiently to allow for the free passage of pedestrians
upon such sidewalk. Goods, wares and merchandise may be displayed
upon the sidewalk or upon tables, counters and racks placed thereon
upon the occasion of special "sidewalk sale days," as declared from
time to time by the Borough Council, but then only in accordance with
conditions set by the Council as to the portion of the sidewalk to
be used for such display and the provision of a passageway of sufficient
width for pedestrians.

A. Any person
who shall violate any provision of this article shall, for each and
every such violation, upon conviction thereof, be sentenced to pay
a fine of not more than $600 and costs of prosecution, and, in default
of payment of such fine and costs, to imprisonment for not more than
30 days. Each day's violation of any provision of this article shall
constitute a separate violation.
B. The Borough
may institute proceedings under this section by the issuance of a
"notice of violation letter," assessing a civil penalty ranging from
$10 to $1,000 for each offense, and provide the parties in violation
of said Code section the opportunity to abate the violation and pay
said civil penalty in lieu of the institution of proceedings and the
imposition of the other stated penalties set forth herein.
