The City of Passaic does hereby adopt and establish, as the Fire Prevention Code of the City of Passaic, the current State Uniform Fire Code, a copy of which is annexed hereto.
Three copies of the currently enforced edition of the State Uniform Fire Code have been placed on file in the office of the City Clerk upon introduction of this chapter for the use and examination of the public.
A. 
All flammable or combustible liquids and flammable liquid compounds or mixtures, including but not limited to gasoline, offered for sale at gasoline service stations, except as required by the provisions of Subsection B below, used for storage, handling or any other use whatsoever in excess of one gallon, in any place whatsoever, shall be conspicuously marked or labeled.
B. 
The labels shall not be required on the following:
(1) 
On beverages, articles of food or drugs.
(2) 
When the container is labeled in accordance with the regulations of the Department of Transportation.
(3) 
When the container is labeled in accordance with the Federal Hazardous Substances Labeling Act and Regulations.
C. 
For all flammable or combustible liquids having a flash point below 140° F., including but not limited to gasoline, a label similar to the following shall be used:
WARNING!
FLAMMABLE OR
COMBUSTIBLE LIQUID
(FLASH POINT BELOW 140° F.)
Keep Away From Heat,
Sparks and Open Flame
Keep Closed When Not in Use
D. 
The container used to hold the flammable or combustible liquids, as stated above, shall be approved by the Department of Transportation.
E. 
All quantities of flammable or combustible liquids and flammable liquid compounds of mixtures, including but not limited to gasoline, offered for sale at gasoline service stations shall not be dispensed in any glass containers.
Pursuant to Section 11 (N.J.S.A. 52:27D-202) of the Uniform Fire Safety Act,[1] the New Jersey Uniform Fire Code shall be locally enforced in the City of Passaic.

The local enforcing agency for the City of Passaic shall be the Bureau of Fire Prevention of the City of Passaic.
The local enforcing agency shall enforce the Uniform Fire Safety Act and all codes and regulations promulgated thereunder on all buildings, structures or premises within the established boundaries of the City of Passaic, exclusive of owner-occupied two-family and one-family residential buildings and federal, interstate or state-owned buildings, and shall faithfully comply with the requirements of the Uniform Fire Safety Act and the Uniform Fire Code.

The local enforcing agency shall be under the direction and control of the Fire Official, who shall report to the Business Administrator of the City of Passaic. The Business Administrator of the City of Passaic shall designate the ranking officer in the Fire Prevention Bureau who is certified by the Commissioner of Community Affairs as the Fire Official.

The local enforcing agency shall include in its table of organization the position of fire prevention specialist, and such fire prevention specialists as may be necessary to enforce the code shall be appointed by the Business Administrator. No person shall be appointed to the position of fire prevention specialist unless such person shall be certified by the Commissioner of Community Affairs.
A. 
All owners and managers of buildings constructed in whole or in part with truss construction shall place or arrange for the placement of emblems permanently affixed to the front of such structures, clearly identifying such buildings as being constructed, in whole or in part, with truss construction. The emblem or emblems shall conform to the following:
(1) 
The emblem shall be a red reflective sign. The shape of the emblem shall be an isosceles triangle and the size shall be 12 inches horizontally by six inches vertically. The following letters, white in color and of a size to make them conspicuous, shall be printed on the emblem: "F" to signify a floor with truss construction; "R" to signify a roof with truss construction; "F/R" to signify both a floor and roof with truss construction.
(2) 
The emblem shall be permanently affixed to the left of the main entrance door at a height between four and six feet above the ground and shall be installed and maintained by the owner of the building.
B. 
Individual structures and dwelling units with truss construction that are part of a planned real estate development shall not be required to have an identifying emblem if there is an emblem affixed to each entrance to the development.
In addition to the enforcement in non-life-hazard uses referenced in § 139-6 above, the local enforcing agency established hereunder shall carry out the periodic inspection of life hazard uses, as required by the Uniform Fire Code, on behalf of the Commissioner of Community Affairs.
Pursuant to the provisions of the Uniform Fire Safety Act, any person aggrieved by any order of the local enforcement agency shall have the right to appeal to the Construction Board of Appeals of the City of Passaic.
