As used in this chapter, the following terms shall have the meanings indicated:
CONTROLLED LANDS
Includes all parks, playgrounds and sports fields located within the Village of Elmsford and all municipally owned or controlled green lands, paper streets, undeveloped rights-of-way and parking lots used in conjunction with shopping centers located within the Village of Elmsford.[1]
PERSON
Includes a human being, a public or private corporation, an unincorporated association, a partnership or a governmental agency.

The following regulations shall be observed at all times within any park, playground and sports field:
A. 
No person shall disturb the peace and good order in any park, playground and sports field by fighting, quarreling or wrangling with loud voices or shouts, threatening violence to any person or the property of others or engaging in clamor or boisterous shouts or conduct or tumult.
B. 
No person shall collect in any park, playground or sports field in bodies or crowds for unlawful purposes or boisterous or riotous assemblage or for the purpose of intentionally annoying, harassing or inflicting property damage or bodily injury to another person or persons.
C. 
No person shall beg, hawk, peddle or solicit within a park, playground or sports field unless he or she has previously obtained a permit authorizing such conduct from the Village Board.
D. 
No person shall play golf or hit any golf ball with any golf club in any park, playground or sports field.
E. 
No person shall loiter in or near toilet buildings in a park.
F. 
No person, except authorized Village employees for the purpose of cleaning or repair, shall enter a toilet room set aside for the opposite sex.
G. 
No person shall bring or keep any dog, cat, household pet or other animal in any park, playground or sports field, except that Seeing Eye dogs are permitted in parks, playgrounds and sports fields.
H. 
No person shall enter, loiter or remain upon or within any park, playground or sports field in a vehicle or otherwise after sunset without a written permit from the Village Clerk or, except in an emergency, cause or permit any vehicle during any part of the nighttime to remain standing in any park, playground or sports field except when its occupant are attending a gathering or function or special event staged therein, upon written permission of the Village Clerk.
I. 
No person shall smoke any cigarette, cigar or pipe of any nature or content in any park, playground or sports field.
J. 
No person shall bet or gamble on any game which is played, conducted, dealt or carried on with cards, dice or other device, nor shall any person bet or gamble on any sporting event being played in any park, playground or sports field, for money, chips, credit or any other representative of value, nor shall any person maintain or exhibit any gaming table or other instrument of gambling therein except at functions authorized by the Village by issuance of a permit.
K. 
No person, except authorized peace officers or other law enforcement officers, shall have, carry, or transport any firearm, air gun, switchblade, hunting knife, slingshot, dagger, metal knuckles, bow, arrow, or other dangerous weapon in any park, playground or sports field.
L. 
No person shall injure, deface, disturb or dirty any part of a park, playground, or sports field or any buildings, signs, equipment or other property found therein.
M. 
Refuse is not to be dropped, thrown or scattered on park, playground or sports field property. All such material, including cans and other metallic substances containing sharp edges, shall be deposited in receptacles provided for such purpose.
N. 
No person shall, either within or outside of a park, playground or sports field, discharge into, throw, cast, lay, drop or leave in any river, brook, stream, storm sewer or drain flowing into or through a park, playground or sports field any substance, matter or thing, either liquid or solid, which may or shall result in the pollution of said river, brook or stream within any park, playground or sports field, interfere with the natural resources of any park, playground or sports field or endanger the health of visitors to any park, playground or sports field.
O. 
No person shall appear in a park in a state of nudity or dressed in such a manner as to indecently expose his or her person.
P. 
No person shall commit, perform or engage in any lewd, lascivious, obscene or indecent act or behavior in a park.
No person shall tent or camp or erect or maintain a tent, shelter or camp in or upon any controlled lands unless said camp or overnight sleeping is part of a program approved by the Village Clerk with written permit therefor.
No person shall kindle, build, maintain or use a fire in any place in or upon controlled lands, except cooking fires shall be permitted in picnic areas designated for outdoor cooking by permit from the Village Clerk. Any such fire shall be under the continuous care and control of a competent person over 21 years of age, from the time it is kindled until it is completely extinguished, and no fire shall be built within 10 feet of any tree, shrub or building or branches of any tree or shrub or in any underbrush. Nothing herein shall be deemed to modify or supersede any provisions of the codes and laws of the Village of Elmsford.
No person shall destroy, cut, pick, deface, mutilate, injure, disturb or remove any plant, flower, shrub, tree, growing thing or plant growth located in or upon any controlled lands or attach any rope, cable or contrivance thereto or set fire to any timber, tree, shrub or plant growth or suffer any fire upon other lands to extend onto any controlled lands.
All written permits as heretofore required shall be in the immediate possession of persons then and there using said controlled lands and shall be exhibited to any elected official, police officer, the Village Clerk or the Superintendent of Highways of the Village of Elmsford upon demand. Failure to produce said permit shall be presumptive evidence that no such permit has been issued.

Except in Carol Nichols Park, no person shall engage in skateboarding, roller-blading or roller-skating in or upon any controlled lands.

Any person who violates any provision of this chapter shall be guilty of violation and, upon the first conviction thereof, shall be subject to a fine which shall not exceed $100 and, on any subsequent conviction thereof, shall be subject to a fine which shall not exceed $500 or to imprisonment for a period not to exceed 15 days, or to both such fine and imprisonment, for each violation.
