Whereas a written request has been received from the owners and/or corporation pursuant to N.J.S.A. 39:5A-1, the provisions of Subtitle 1 of Title 39 are hereby made applicable to the properties listed below. Specific regulations of request and plot plans are on file in the office of the City Clerk and are hereby made a part of this Part 3.

Editor's Note: This ordinance also provided as follows:

"Section II. The areas described herein define limits of parking prohibition to facilitate access to buildings on the site by fire-fighting personnel and equipment.

"Section III. The parking prohibitions are to be signed by the property owners at their own expense using signs consistent with the Manual on Uniform Traffic Control Devices.

"Section IV. The application and enforcement of the parking prohibition on each individual property is subject to the owner requesting by letter that, pursuant to N.J.S.A. 39:5A-1, the provisions of Subtitle 1 of Title 39 be made applicable to their property and subsequent Council concurrence by resolution to such request."

The following described locations are hereby designated as restricted parking for use by handicapped persons:

A.

Fire Officials and fire inspectors pursuant to § 139-4 shall enforce violation of fire lanes within the City of Passaic.

B.

All fire lanes established pursuant to § 295-34.1 shall be subject to enforcement once notice has been given to the property owners of the area set forth in § 295-34.1 by certified and regular mail. Thirty days after notice, fire Officials and fire inspectors shall be authorized to enforce fire lane parking violations pursuant to this section and a summons shall be issued concerning that violation.

Any person found parking in a fire lane shall be liable for a fine of $50 per violation.

Appeals of a fire lane violation shall be filed with the Passaic County Construction Board of Appeals.

A.

Pursuant to N.J.S.A. 39:4-138i, it is a traffic violation to park within 10 feet of a fire hydrant.

B.

Fire Officials and fire inspectors are hereby authorized to give out summonses for violations of this statute concerning the parking within 10 feet of a fire hydrant.
