The 2006 International Property Maintenance Code, as published by the International Code Council (ICC), is hereby adopted as the Property Maintenance Code of the Borough of Rocky Hill, County of Somerset, in the State of New Jersey, for the control of buildings and structures as herein provided; and each and all of the regulations of the 2006 International Property Maintenance Code are hereby referred to, adopted, and made a part thereof, as if fully set out in this chapter, with the additions, insertions, deletions and changes, if any, described in § 140-2 of this chapter.

The following sections of the aforesaid ICC Code are hereby modified as to their application in the Borough of Rocky Hill as follows:
A. 
Section 101.1 Title. These regulations shall be known as the "Property Maintenance Code of the Borough of Rocky Hill," hereinafter referred to as "the Property Maintenance Code" or "this code."
B. 
Section 104.1 General. The code official shall enforce the provisions of this code. The Borough of Rocky Hill designates the Zoning Officer as the primary code official for enforcement of this chapter. If required, the Mayor, with the advice and consent of the Borough Council, may designate an additional code official or officials through appointment or contractual services agreement.
C. 
Section 106.4 Violation penalties. Any person who violates any provision of this chapter shall, upon conviction, be punished as provided in Chapter 1, General Provisions, Article I, General Penalty, of the Code of the Borough of Rocky Hill. Each day that a violation continues after due notice has been served shall be deemed a separate offense.
D. 
Demolition Section 110.2 Notices and orders. All notices and orders shall comply with Section 107. Anyone affected by any such order shall, within 10 days after service of such order apply to a court of record for an order restraining the code official from razing and removing such structure or parts thereof. The court shall determine whether the order of the Code Official is reasonable; and if found reasonable, the court shall continue the restraining order or modify it as the circumstances may require.

Nothing in this chapter or in the Basic Property Maintenance Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquitted, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in § 140-2 of this chapter, nor shall any just or legal right or remedy of any character be lost, impaired or affected by this chapter.
