No person under the age of 14 shall operate a two-wheeled bicycle
or a skateboard in the Village of McGraw unless such person is wearing a helmet
meeting of the standards of the American National Standards Institute (ANSI
Z 90.4 Bicycle Helmet Standards) or the Snell Memorial Foundation's 1984 Standard
for Protective Headgear for use in Bicycling. For the purpose of this subsection,
"wearing a helmet" means having a helmet of good fit fastened securely under
the head with the helmet straps.
A violation of this subsection shall be punishable by a fine
of up to $50 for a first offense committed and by a fine of up to $100 for
a second offense. For each subsequent offense committed within one year of
the last offense, the fine shall be up to $100 and/or community service to
be determined by the Court in an amount not to exceed 25 hours. The fine shall
be levied against the parent or guardian of the child, said parent or guardian
shall be issued a summons to appear in Court with the child.
Any violation of this article shall be punishable by a fine not to exceed
$250 or by imprisonment for a term not to exceed 15 days, or both.
