[Adopted 9-6-1989 (§§ 16-1 to 16-8
of the 1974 Code)]
The Newington Town Council hereby declares that a local housing partnership
is to be formed, in accordance with Public Act 88-305, C.G.S. § 8-336f,
in order to develop ways to increase the supply and availability of affordable
housing in the Town of Newington.
There is hereby created the Newington Housing Partnership, to be appointed
by the chief elected official of Newington.
The Partnership shall consist of 11 members as follows:
A. The chief elected official.
B. One member of the Housing Authority.
C. One member of the Town Plan and Zoning Commission.
D. One member of the Development Commission.
E. One member of the Fair Rent Commission.
F. One member of the Conservation Commission.
G. Two representatives of the local business community.
H. Two representatives of public interest groups, such as
a housing advocate, a member of the clergy, a member of a local civic group,
or a representative of a local nonprofit housing corporation.
I. One representative of local urban planning, land use,
and housing professionals.
The responsibilities of the Newington Housing Partnership, in order
to receive initial designation of the Connecticut Housing Partnership Program,
shall include the following:
A. Submit evidence to the Commissioner of Housing that the
Newington Housing Partnership has been formed in accordance with Public Act
88-305, C.G.S. § 8-336f; and
B. Submit evidence to the Commissioner of Housing that sufficient
local resources have been committed to the Newington Housing Partnership.
Duties of the Newington Housing Partnership, in order to receive development
designation under the Connecticut Housing Partnership Program, shall include
the following:
A. To examine and identify housing needs and opportunities
in the community;
B. To explore the availability of any state, municipal or
other land that is suitable for the development of affordable housing;
C. To review applicable Zoning Regulations to determine
whether such regulations restrict the development of affordable housing in
the community;
D. To identify any necessary changes to such regulations;
E. To establish priorities and develop a long-range plan
to meet identified housing needs in the community consistent with regional
housing needs;
F. To establish procedures for the development of a written
proposal to achieve such priorities in accordance with said plan; and
G. To start an activity, development or project designed
to create additional affordable housing in Newington, subject to the approval
of the Town Council and the Town Plan and Zoning Commission.
At all times when any orders, rules and regulations made and promulgated
pursuant to this article shall be in effect, they shall supersede all existing
resolutions, orders, rules and regulations made pursuant to this article insofar
as the latter may be inconsistent therewith.
This article shall not be construed so as to conflict with any state
or federal statute, rule or regulation.
No person shall have the right to expend any public funds of the municipality
in carrying out any partnership activities authorized by this article without
prior budgetary approval by the Town Council. The Town Manager shall have
the right to bind the Town by contract or agreement upon specific authorization
of the Town Council.

The Newington Town Council hereby establishes a Newington Affordable
Housing Monitoring Agency (hereinafter referred to as "monitoring agency")
in accordance with C.G.S. § 8-2g.
The purpose of the monitoring agency as set forth in C.G.S. § 8-2g(a)
and (b) shall be to prepare, adopt and administer standards for selecting
eligible households to participate in affordable housing programs resulting
from density increases granted by the Newington Town Plan and Zoning Commission
or from other affordable housing programs that may be sponsored by the Town
of Newington.
The Newington Affordable Housing Monitoring Agency shall consist of
five members who shall serve staggered five-year terms expiring on November
30 in a given year. The term of only one member shall expire in a given year.
There shall be no more than four members from one party. If an existing agency
is appointed to monitor affordable housing, the make-up of that body shall
constitute the make-up of the Newington Affordable Housing Monitoring Agency.
The responsibilities of the monitoring agency shall including the following:
A. Prepare and publish selection criteria for participation
in affordable housing developments constructed in the Town of Newington. This
criteria may include factors such as family income, family size, residency
and employment in the Town of Newington, employment by the Town of Newington,
and housing hardship considerations. Income criteria shall be based on standards
published by the U.S. Department of Housing and Urban Development for the
Hartford PMSA.
B. Review the contract that a developer of single-family,
entry-level housing prepares pursuant to § 8.3.2D(a)(b) of the Newington
Zoning Regulations.
C. Review the proposed sale prices of proposed affordable
housing developments to determine that prospective households meeting the
selection criteria can purchase the units once they are built.
D. Review the proposed deed restrictions and covenants for
affordable housing to determine that resale will be to households who meet
selection criteria set by the monitoring agency.
E. Report to the Town Plan and Zoning Commission and to
the sponsor and/or developer of the proposed affordable housing that the proposed
sale prices, deed restrictions and contract comply with the selection criteria
established by the monitoring agency.
F. Maintain a file of eligible participants
for use by the sponsors, developers and sellers of proposed affordable housing.
The role and responsibility of the monitoring agency shall include the screening
and certification of households as meeting the Town's affordable housing criteria.
Eligible households shall be responsible to obtain their own financing commitments,
and this will not be the responsibility of the monitoring agency or the Town
of Newington.
The facilities and services of the various agencies and departments
of the Town of Newington, including that of the Town Attorney, shall be available
to the monitoring agency as needed. The Town Manager shall be responsible
for providing administrative assistance and may direct and assign staff to
the monitoring agency.
No person shall have the right to expend any public funds of the municipality
in carrying out any monitoring agency activities authorized by this article
without prior budgetary approval by the Town Council.
