The accumulation, collection, removal and disposal
of refuse must be controlled by the Town of Newington for the protection
of the public health, safety, and welfare. The Town Council finds
that, to give practical effect to this policy, a comprehensive system
for the periodic collection, removal and disposal of refuse and recyclables
from certain residential premises and regulation of the collection,
removal and disposal of refuse and recyclables from nonresidential,
institutional, commercial, and industrial premises and complexes is
essential to public health and benefits all the citizens of the Town.
As used in this chapter, the following words
and terms shall have the meanings indicated:
Any dwelling complex on one piece of property which accommodates
more than three dwelling units for rental occupancy, including hotels
and motels.[1]
Land-clearing debris and waste resulting directly from demolition
activities other than clean fill.
Natural soil, rock, brick, concrete, and asphalt paving fragments
which are virtually inert and pose neither a pollution threat to groundwaters
or surface waters nor a fire hazard.
The most general association of property owners formed for
the government and management of a particular residential condominium.[2]

The owner, renter, or other occupant of each separate dwelling
unit, whether or not in the same building with other dwelling units.
Any room or group of rooms located within a dwelling and
forming a single, habitable unit with facilities which are used or
intended to be used for living, sleeping, cooking and eating.
Putrescible animal and vegetable waste resulting from the
handling, preparation, cooking and consumption of food.
Yard vegetation waste and similar materials emanating from
nonresidential premises and apartment complexes, excluding leaves.
Dangerous materials or substances which may pose a present
or potential hazard to human health or the environment when improperly
treated, stored, transported or disposed of, including but not limited
to cleaning fluids, paints, explosives, acids, caustics, poisons,
drugs, radioactive materials or infectious materials and asbestos-containing
material.
A single piece of property used primarily for dwelling purposes
in conformance with all local and state regulations, but which accommodates
no more than three rental dwelling units.
The manufacture, milling, assembly, or warehousing of a product,
the maintenance and/or storage of commercial vehicles or construction
equipment, quarrying, or other extractive activities.[3]
Premises used for wholesale or retail trade, business and
professional offices, industry, churches, private schools, nonprofit
organizations, farms operated as a business, state or federal government
buildings, hospitals and other humane institutions, orders of fraternal
organizations, clubs, and places of amusement, entertainment, or recreation.

Household items, including, but not limited to, sofas, mattresses,
furniture, machinery, and appliances.
Residential developments as defined in former Chapter 124a,
or development used for residential purposes as defined in Chapter
828 of the Connecticut General Statutes, as revised, or individually
owned residential units as allowed by the Town Plan and Zoning Commission
in the Residence Planned District (RPD).

Land, building or other structures, trailers, vehicles or
parts thereof upon or in which refuse is stored.
Clean newspaper (and inserts), glass and metal food/beverage
containers, plastic food/beverage/detergent containers, cardboard,
office paper, scrap metal, waste motor oil, vehicle or boat batteries,
and leaves, and any other item(s) so designated by the Town Manager.

Garbage, rubbish, bulky wastes, and oversize waste, excluding
body wastes, hazardous wastes, clean fill, general vegetative waste,
and recyclables.
Any group of individually owned dwelling units having ownership
in common of shared facilities, organized under Chapter 825 of the
Connecticut General Statutes, as revised, and in which no more than
10% of such dwelling units are owned by the same person.
All dwelling units in Town except those in an apartment complex.
Cold ashes, junk, discarded containers, dust, sweepings,
wastepaper, boxes, crates, rags, clothing, textiles, glass (other
than food and beverage containers), crockery, and similar solid waste
materials ordinarily accumulated in and around independent residential
premises and residential condominiums, excluding body wastes, hazardous
wastes, bulky wastes, and clean fill.
The duly appointed Town Manager of the Town of Newington,
or his or her designee.
Any permitted solid waste and or recycling facility designated
by the Town Manager.

Grass clippings, weeds, garden plants, shrubs, leaves, branches,
limbs, brush and similar materials grown on and emanating from residential
premises within the Town of Newington.
