The Town shall make available facilities for the disposal of general vegetation waste; such facilities may be located outside the boundaries of the Town. Only yard vegetation waste and such waste from Town government operations shall be disposed of in facilities operated by the Town unless approved in writing by the Town Manager. The disposal of yard vegetation waste at a Town-operated facility shall be limited to the owners and/or occupants of residential premises utilizing a personal pickup truck, auto/trailer (trailer no longer than 10 feet) combination, compact window or compact cargo van, or passenger car, unless approved in writing by the Town Manager. Leaves from Newington may be disposed of by private contractors at the Town's landfill or leaf recycling center with permission from the Town Manager. No person shall violate the regulations applying to the vegetation waste disposal facility which is being used or fail to heed the directions of an attendant of such facility or an authorized representative of the Town. The Town Manager, with approval of the Town Council, may from time to time adopt regulations governing the use of a vegetation disposal facility operated by the Town and the type of material that may be disposed of in such a facility.
A. 
Required. No person shall dispose or attempt to dispose of general vegetation waste at a facility made available by the Town in accordance with § 332-10 without first having obtained a license for same. Such license, and applicable fees, shall be for periods established by the licensing authority.
B. 
Conditions for issuance. The Town Manager shall grant a license for use of such facility operated by the Town within a reasonable time following the filing of a proper application unless the Manager finds that the applicant has been irresponsible in the disposal of yard vegetation waste based upon previous suspensions and/or revocations of licenses under this chapter.
C. 
Suspension and revocation authority. The Town Manager is authorized to suspend or revoke the license of any person who violates the terms of this chapter or any regulations made pursuant hereto or who shall be found to have falsified any application made to obtain such license. No license shall be granted until all information pertinent to the license application has been provided by the applicant to the satisfaction of the Town Manager.
D. 
Display of identification. Each vehicle licensed by the Town Manager under this section shall display the identification provided by the Town in the manner described by regulations of the Town Manager. The owner of any vehicle failing to display such identification shall be in violation of this section.
E. 
Inspection of load. When presenting yard vegetation waste at a disposal facility operated by the Town, the operator of each vehicle licensed hereunder shall submit for inspection and documentation any load of such waste which the Town Manager has cause to believe may contain materials originating from premises other than the vehicle operator's. The presence of such materials shall be considered fraud against the Town and shall be cause for suspension of a license by the Town Manager for not less than one year for the first offense and up to an indefinite term for a second offense, as determined by the Town Manager.
