It shall be unlawful for any person to install, operate or maintain a food vending machine or to engage in the business selling or dispensing food, beverage or refreshments from a vending device in any location such as stores, restaurants, roadside stands, refreshment stands, factories, schools, offices, theaters, clubs, lodges, or buildings of public assembly, except after obtaining a license as hereinafter provided.
Licenses to install, operate, maintain or erect vending machines or engage in the business of selling or dispensing food, beverages, or refreshments from a vending device in places referred to in § 344-63 may be granted by the Health Department upon application in writing. Application forms for such licenses shall set forth the name and address of the applicant, name and address of the owner or manager of the establishment where such machine shall be located, a list of the products to be vended, and the type or types of vending machines to be used. Each licensed machine shall be identified by the licensee on the face thereof with the name and address of the licensee and the number of the license issued to said licensee.
A license shall be deemed necessary for any machine or device dispensing soft drinks, soup, coffee, tea, hot cocoa, fruit, fruit juices, snacks, popcorn, candy including gum, sandwiches, sherbet, ice, ice cream, milk, or any other food product.
Food vending machines owned and operated by nonprofit organizations and located on the premises of said nonprofit organizations shall be exempt from payment of food vending machine license fees as stipulated in § 344-26B of this code.
If upon inspection, the Health Officer or his agent(s) shall find, or has probable cause to believe, that any food, beverage or refreshment sold or dispensed from a vending device is not free from dust, contamination, or foreign substance, the inspector shall affix to said vending machine or device a tag or other appropriate marking, giving notice that such vending machine or device is suspected of being in violation of this chapter, and carrying a warning to all persons not to remove or dispose of any articles in said vending machine or device by sale or otherwise until permission for removal or disposal is given by the Health Officer or his agent.
