This chapter is enacted pursuant to the authority of Article 9-A of the General Municipal Law of the State of New York and shall be known as the "Games of Chance Ordinance of the Town of Brant."
The words and terms used in this chapter shall have the same meanings as such words and terms are used in Article 9-A of the General Municipal Law.
Authorized organizations may, upon obtainment of a license from the Clerk of the town, conduct games of chance within the town as provided in Article 9-A of the General Municipal Law and as provided further in this chapter. Such games of chance shall be conducted in accordance with the general state law and with the rules and regulations of the New York State Racing and Wagering Board and this chapter.
The powers and duties set forth in Subdivision 1 of § 194 of the General Municipal Law shall be exercised by the Chief of Police of the Town of Brant.
Except as may otherwise be provided in Article 9-A of the General Municipal Law of the State of New York, the provisions of this chapter shall not be effective in the Town of Brant, County of Erie and State of New York, unless and until a proposition submitted at a general or special election shall be approved by a vote of the majority of the qualified electors in said Town of Brant, County of Erie and State of New York. Upon an approving vote, this chapter shall take effect on the 30th day thereafter.[1]
