For the purpose of this chapter, certain words
and terms used herein are defined as follows:
BOND
A performance bond duly issued by a bonding or surety company
approved by the Village Board of Trustees or a performance bond duly
issued by the owner accompanied by security in the form of cash, certified
check or United States Government bearer bonds deposited with the
Village Board of Trustees in the full amount of the obligation.
COMPREHENSIVE PLAN
The materials, written and/or graphic, including but not
limited to maps, charts, studies, resolutions, reports and other descriptive
material, that identify the goals, objectives, principles, guidelines,
policies, standards, devices and instruments for the immediate and
long-range protection, enhancement, growth and development of the
Village. The "Village Comprehensive Plan" shall, among other things,
serve as a basis for land use regulation, infrastructure development,
public and private investment and any plans which may detail one or
more topics of a Village "comprehensive plan."
EASEMENTS
A property right giving the owner or holder thereof the right
of access to land for a specified purpose.
ENGINEER
The duly designated engineer of the Village or, if there
be no such official, the licensed engineer employed by or assigned
to the Planning Board.
LOTS
A.
CORNER LOTA lot situated at the junction of and adjacent to two or more intersecting streets when the interior angle of intersection does not exceed 120°.
C.
REVERSE-FRONTAGE LOTSLots with the rear lot lines abutting an existing or proposed limited-access highway or public reservation.
OFFICIAL MAP
The map established by the Village Board of Trustees under
§ 7-724 of the Village Law showing the streets, highways
and parks theretofore laid out, adopted and established by law and
all changes and additions thereto made under the provisions of the
Village Law.
OWNER
The owner of the land proposed to be subdivided or his/her
agent.
PLANNING BOARD
The duly constituted Planning Board of the Village of Ballston
Spa, New York.
PLATS
A.
FINAL PLATA drawing prepared according to Article
IV of this chapter that shows a proposed subdivision containing, in such detail as required, all information required to be shown on a preliminary plat and the modifications, if any, required by the Planning Board at the time of approval of the preliminary plat if such preliminary plat has been so approved.
B.
PRELIMINARY PLATA drawing prepared in the manner prescribed in Article
IV of this chapter showing the layout of a proposed subdivision, including but not limited to road and lot layout and approximate dimensions, key plan, topography and drainage and all proposed facilities, including preliminary plans and profiles, at suitable scale and in such detail as this chapter requires.
STREETS
A way for vehicular traffic, whether designated as a street,
highway, thoroughfare, parkway, road, avenue, boulevard, lane, cul-de-sac,
place or however otherwise designated.
A.
ARTERIALThose streets which are used primarily for fast or heavy traffic.
B.
COLLECTORThose streets which carry traffic from minor streets to the major system of arterial streets, including the principal entrance streets of a residential development and streets for circulation within such a development.
C.
MINORThose streets which are used primarily for access to abutting properties.
D.
MARGINAL-ACCESSThose streets which are parallel to and adjacent to arterial streets and which provide access to abutting properties and protection from through traffic.
STREET SUPERINTENDENT
The person employed and designated by the Village Board of
Trustees responsible for the maintenance of the streets in the Village.
STREET TREES
Those trees in or within 20 feet of the right-of-way.
STREET WIDTH
The distance between property lines measured across the street
and perpendicular to its direction at the line of measurement.
SUBDIVISION
The division of any parcel of land into two or more lots,
blocks or sites as specified, with or without development. The term
"subdivision" shall include any alteration of lot lines or dimensions
of any lots or sites shown on a plat previously approved and filed
in the office of the County Clerk or register of the county.
WATER SUPERINTENDENT
The person employed and designated by the Village Board of
Trustees responsible for the operation and maintenance of the Village
water system.
