As used in this chapter, the following terms shall have the meanings indicated, unless a different meaning clearly appears from the context:
PARK or PARKS
Unless specifically limited, shall be deemed to include all parks, playgrounds, recreation areas, tennis courts, beaches, boat access ramps, recreation structures and facilities, and also entrances and approaches thereto, and all other land or property or structures under the jurisdiction of the Recreation Board, now or hereafter owned or acquired by the Athens Township for park or recreational purposes.
PERSON
Any natural person, corporation, organization of persons, company, association or partnership.
RULES AND REGULATIONS
Any rules and regulations hereby or hereafter promulgated by the Recreation Board under the authority herein conferred.

All parks shall be opened daily to the public at such hours as the Recreation Board may from time to time designate. Presently, the park hours are from dawn until dusk in all parks. However, fishing will be permitted at Tozer's Landing at all times.

All persons in attendance at any of the parks shall conduct themselves in accordance with the rules prescribed by the Board of Supervisors and/or the Recreation Board. The current rules of conduct are set forth in Exhibit A which is attached hereto and fully incorporated by reference into this article.[1]

The operation of recreational vehicles is only allowed within Round Top Park and all such vehicles must be operated in accordance with the Rules and Regulations of the Recreation Board. The current rules and regulations are as set forth on Exhibit B which is attached hereto and fully incorporated by reference into this article.[1]

All laws pertaining to fishing and hunting in the commonwealth shall apply to fishing and hunting in parks and recreation areas, and provisions thereof are hereby incorporated by reference.
The use of all parks shall be on a first-come, first-served basis unless otherwise reserved:
A. 
By annual permission granted by the Recreation Board for the scheduling of various league games, etc.;
B. 
For school or college athletic games, practice, contests or exhibitions;
C. 
For regularly scheduled school district or municipal recreation and education programs; or
D. 
By permission granted by the Recreation Board for a specific requested use.
The Recreation Board is authorized to establish additional rules and regulations as deemed necessary and with approval of the Athens Township Supervisors.
Recreation facilities which become hazardous for public use due to weather, water, fire or unforeseeable conditions may be closed only at the discretion of the Recreation Board or the Board of Supervisors or the Police Chief of Athens Township.
The police officers of the Athens Township are charged with enforcement of the provisions of this chapter and of rules and regulations promulgated by the Recreation Board.

Any person who violates any of the provisions of this article commits a summary offense and shall, upon conviction thereof, be sentenced to pay a fine of not more than $500 plus costs of prosecution and, in default of payment, to undergo imprisonment for a term not to exceed 90 days. Each day that a violation of any of the provisions of this article continues shall constitute a separate violation.

All persons attending, using, or otherwise occupying any portion of Round Top Park on and from November 15 to and on December 15 of each year shall wear a minimum of 250 square inches of fluorescent orange material on their chests and backs or heads. Said fluorescent orange material shall be visible from any angle within 360° of the person.
This provision shall not apply to members of any federal or state law enforcement agency, Game Commission Officer, or Township police officer while on or engaged in active law enforcement duties.
Any persons violating any of the provisions of this article shall, upon conviction, be ordered to pay a fine not less than $25 nor more than $100 per offense, plus the costs of prosecution and, in default thereof, to undergo imprisonment for not more than 10 days.
