This chapter shall be known as the "Town of
Niagara Developers' Specifications."
The chapter shall apply to all subdivisions
of land, construction projects, utility installation and all other
actions governed by the terms of this chapter, within the Town of
Niagara.
The Town Board, after consultation with the
appropriate heads, shall have the authority to change any fee, penalty
or bond amount set out in this chapter, or any appendix to this chapter,
by resolution.
For convenience, definitions contained in this
chapter have been grouped in the particular articles. All definitions
contained in this chapter apply to the entire chapter, not just to
the particular article within which the definition is placed.
Unless specifically stated otherwise in the
particular section, all Town approval required under these developers'
specifications shall be by decision of the Code Enforcement Officer
or by the Code Enforcement Officer's designee.
If any section, subsection, sentence, clause,
phrase or other portion of this chapter is, for any reason, held invalid
or unconstitutional by any court of competent jurisdiction, such portion
shall be deemed as a separate, distinct and independent provision
and such holding shall not affect the validity of the remaining portions
thereof.
This chapter shall be effective upon filing
with the Secretary of State.
