Prior to the installation of any water service to properties outside the limits of the Town of Niagara, the Town Board of the Town of Niagara must give its approval and consent of such water service upon such terms and conditions as said Town Board may deem appropriate, and each request for such water service shall be passed on by said Town Board without regard to any previous approvals or denials of similar requests.
In each case where water service outside the limits of the Town of Niagara is approved by the Town Board, then the water service lines shall be installed by the Town of Niagara Water Department, and the Town Board may impose, as one of the conditions for the furnishing of such water service, reimbursement for the installation cost of said water lines.
The Town of Niagara Water Department shall install a water meter to measure the water usage for the property serviced, and said water meter shall remain the property of the Town of Niagara.
The rate for such approved users of the Town of Niagara water service shall be double the standard Town of Niagara minimum rate for the minimum quarterly usage for the water service, and any water usage in excess of the minimum billing usage on a quarterly basis will be charged at the standard Town of Niagara rate for said water usage.
The continuation of any water service outside the Town of Niagara shall be subject to any and all rules and regulations of the State of New York and of any and all state agencies or commissions having jurisdiction thereon, and such water service shall continue at the pleasure of the Town Board of the Town of Niagara.[1]
