The following words, when used in this article,
shall have the following meanings:
PERSON
Any natural person, firm, partnership, association, corporation,
company or other legal entity.
RECREATIONAL VEHICLE
A vehicle used customarily for human inhabitation or recreational
activities during tours or vacation periods, including but not limited
to travel homes, travel trailers, motor homes, truck campers, tent
campers, trailers, boats and trailers, snowmobiles and trailers and
any other similar vehicle.
It shall be unlawful for any person to park or leave standing any type of motorized or nonmotorized vehicle having a gross weight in excess of 14,000 pounds or having a width in excess of 80 inches upon any street within Zoning Districts RR, SR, UR, OR, AB and IR, so designated any time and from time to time in the Bern Township Zoning Ordinance and Official Map (Chapter
184); provided, however, that such motorized or nonmotorized vehicle may be parked temporarily in those areas, for purposes of loading and unloading construction materials or equipment, household goods, furniture, residential refuse or recycling, or other merchandise, property or wares used in connection with a residence or other building, in which case the motorized or nonmotorized vehicle shall be removed immediately after the loading or unloading operation is completed. A period of 12 hours shall be the maximum period of time permitted for such operations. Nonmotorized vehicles, referred to above, used in connection with the operation of a business and for commercial purposes may not be parked for loading and unloading purposes in those areas, unless temporarily parked in conjunction with the construction, maintenance, removal, repair or remodeling of a building located within 50 feet of the parked vehicle.
Except during the action of loading or unloading,
it shall be unlawful for any person to park or leave standing any
type of recreational vehicle upon any street, alley or cartway within
the Township so as to cause or create an impediment to traffic or
obstruct the view of or proper sight triangle at any intersection.
The following shall be additional restrictions
for recreational vehicles:
A. Laying lines across sidewalks or streets prohibited.
It shall be unlawful for any cords, hoses or lines of any kind to
be laid or maintained across any public sidewalk, street, alley, or
cartway in connection with the usage of a recreational vehicle, except
for the purpose of routine maintenance or loading or unloading of
said recreational vehicle.
B. Restrictions on operation of auxiliary equipment.
It shall further be unlawful to operate any equipment auxiliary to
any such recreational vehicle, such as generators, air compressors,
air conditioners or similar equipment, between the hours of 8:00 p.m.
and 8:00 a.m.
C. Restrictions on permanent parking or storage. It shall
be unlawful for any person to permanently park or leave standing any
type of recreational vehicle within the Township, except that a recreational
vehicle may be stored, unoccupied, upon private property, including
but not limited to storage on private roads owned by or leased to
the owner of such recreational vehicle as follows:
(1) Storage of any recreational vehicle shall be in strict compliance with the Township Zoning Ordinance (Chapter
184).
(2) No recreational vehicle shall be stored in any front
yard where there is an existing driveway or other access to a rear
yard adequate to store the recreational vehicle.
(3) No recreational vehicle shall be stored or parked
so as to encroach upon or extend over any public sidewalk.
D. Occupation for living purposes prohibited. It shall
be unlawful for any recreational vehicle to be occupied for living
purposes within the Township, unless permitted by the Township in
connection with a special event, large gathering or other permitted
exception.
(1) Permit request. A request to allow a recreational
vehicle to be occupied for living purposes in the Township shall be
made to the Township Manager, and if the requestor is aggrieved by
the decision of the Township Manager, he may appeal said decision
to the Board of Supervisors for its consideration.
Any person who shall violate any provision of
this article shall, upon conviction thereof, be sentenced to pay a
fine of not less than $100 nor more than $1,000 and/or imprisonment
for a term not to exceed 90 days.
