Alongside and in front of all lots or parcels of land in the Town, the
owners of said lots or parcels of land shall make and maintain a good curb
and gutter of concrete. Said curb and gutter shall be what is known as a "combination
concrete curb and gutter," except where curbs have already been made of other
or different material and approved by the Mayor and Council at the time of
the passage of this article (1922). Every such curb and gutter shall be laid
under the direction of the Mayor and Council, to conform to the grade established
by the Mayor and Council of Myersville, and according to such plans and specifications
as are now or may hereafter be adopted by the Corporation of Myersville, and
said curbs shall be subject at all times to the inspection and approval of
the Mayor and Council.
In case the owners of any such lots are nonresidents of Myersville, then the notice above mentioned shall, in the discretion of the Mayor and Council, be served on the tenant or person in charge of said lots or property, and in case of failure, after said notice, by the tenant or owners to make or repair said curbs and gutters as provided in §
124-5, and provided further that in case the tenant causes said curbs and gutters to be made or repaired in accordance with said notice, then the amount as expended by such tenant may be by him withheld from the rental due by him to the owner of such lot or property in accordance with the provisions of the Charter of Myersville.
