The system of apartheid in the Republic of South Africa which has been condemned by the United Nations as "a crime against humanity" systematically denies economic, political and social freedoms to the vast majority of the populace. Apartheid laws which separate black families, keep blacks in the lowest paying jobs and deny them the right to vote exemplifies the institutionalized violation of human rights. Millions of dollars of public moneys are invested or deposited by state, county and municipal governments in banks and other financial institutions doing business in or with the Republic of South Africa. These moneys support the racist government of South Africa. Therefore, the people of the City of Rahway declare that public moneys should be removed from banks or other financial institutions doing business in or with the Republic of South Africa.
For the purpose of this article, the following terms shall have the meanings indicated:
CITY FUNDS
Any moneys invested or deposited directly by the City of Rahway.[1]

Before any City funds can be deposited or invested in any bank or financial institution, the Comptroller shall require that each bank or financial institution submit an affidavit certifying that said bank or financial institution does not, directly or through a subsidiary, have any loans to:
A. 
The Republic of South Africa;
B. 
A national corporation of or other corporation organized under the laws of the Republic of South Africa; and
C. 
Any other company for the purpose of investment in the Republic of South Africa.

All organizations that request and/or accept funds from the City of Rahway shall permit full access to their financial records upon reasonable request made by the City of Rahway.
Where a request has been made by the City to obtain access to an organization's financial records, the organization shall provide such access within 10 calendar days.
For a violation of any provision of this article, in addition to the penalties which are authorized to be imposed under N.J.S.A. 40:49-5, the governing body may by resolution cut off all municipal funding to the organization.
