There shall be established within the County
of Union a County Board of Appeals to hear appeals of the decisions
by the enforcing agency within its jurisdiction. Application and procedure
for filing such appeals shall be in accordance with Regulations, New
Jersey Uniform Construction Code, Article 15 — Construction
Board of Appeals.

A. New Jersey state permit surcharge fees: per N.J.A.C.
5:23-4.19.
(1) Exempt construction activities pursuant to:
(a)
N.J.S.A. 52:27D-126c: erection or alteration
of public buildings; prohibition of fees.
(b)
N.J.S.A. 52:27D-126e: waiver of construction
permit surcharge or enforcing agency fee for construction to promote
accessibility by handicapped to existing structure or facilities therein.
(c)
N.J.S.A. 52:27D-130.2 and 130.3: construction
permit for installation or alteration of solar energy heating or cooling
system; municipal/state fee or charge; prohibition.
B. Municipal administrative fees:
(1) Plan review. The fee for plan review shall be 25%
of the amount to be charged for the construction permit. The amount
paid for this fee shall be credited toward the amount of the fee to
be charged for the construction permit. The fee for plan review shall
not be refundable. [N.J.A.C. 5:23-4.18(a)1 and (b)1]
(2) Reinstatement of a construction permit that has become
invalid in accordance with the Uniform Construction Code shall be
the full price of the permit as calculated by most current adopted
fees. [N.J.A.C. 5:23-4.17(a)1]
(3) Subcode variations: $750 for Class I structures and
$250 for Class II and III structures.
(4) Certificate of occupancy for new construction, additions,
alterations and temporary uses: 10% of the building subcode fee with
a minimum fee of $200, provided that additions and alterations under
1,500 gross square feet shall be $75.
(5) Certificate of continued occupancy [N.J.A.C. 5:23-2.23(e)]:
$300 (by Building, Fire, Electric and Plumbing Subcode Official).
(6) Temporary and renewal of certificate of occupancy:
$100. Note: No initial fee charged, provided certificate of occupancy
fee is paid at time of request.
(7) Change of use group certificate of occupancy: $150.
(8) Lead abatement clearance certificate: $150.
(9) The total fee shall be rounded to the nearest dollar
amount. [N.J.A.C.5: 23-4.17(a)]
(10) No permit shall be required for ordinary maintenance.

(11) No fee shall be charged for a certificate of approval
or a certificate of compliance,. [N.J.A.C. 5:23-4.18(f)J and 6]
(12) Fees for combination renovations and additions shall
be the sum of both N.J.A.C. 5:23-4.18(c)1.iv. and N.J.S.A. 52:27D-119.1
et seq.
(13) Fee for change of contractor: $50.
(14) Elevator fees shall be as set forth in N.J.A.C. 5:23-4.14(g).
(15) Fee schedule discounts shall be pursuant to §
177-3H.

C. Building subcode fees; all use group fees.
(1) For new construction and additions: the amount shall
be $0.04 per cubic foot of building structure volume, provided the
minimum fee shall be $200.
(2) For renovations, alterations, repairs, re-roofing,
re-siding, tents, membrane structures, tanks and site construction
associated with off-street parking lots, such as, but not limited
to, sign/light poles, barrier-free improvements, retaining walls and
retention basins. Pre-engineered systems, premanufactured construction
and their external utility connections, and appurtenances for which
specific volume cannot be calculated shall be based upon the estimated
cost of work. The fee shall be the amount of $30 per $1,000 for the
first $100,000 of cost and $25 per $1,000 for remaining cost of construction
over $100,000, provided that the minimum fee shall be $100. For the
purpose of determining estimated cost, the applicant shall submit
cost data as may be available by the architect or engineer of record,
or by a recognized estimating firm or by a bona fide contractor's
bid. The Construction Code Official shall make the final decision
regarding estimated cost.
(3) For the construction or installation of a swimming
pool or hot tub: aboveground $100; or in-ground: $300.
(4) For the demolition of a building or structure: $400,
provided that the fee shall be $100 for structures under 500 square
feet in area.
(5) For removal of a building or structure from one lot
to another or to a new location on the same lot: $26 per $1,000 of
the estimated moving costs, including the cost for new foundations,
provided that the minimum fee shall be $175.
(6) To construct, alter or erect a sign: $1.75 per square
foot of surface area of the sign, to be computed on one side only,
provided that the minimum fee shall be $100.
(7) Installation and replacement of sheds exceeding 100
square feet or 10 feet in height and fences over six feet high or
replacement of barriers surrounding private or public swimming pools
[N.J.A.C. 5:23-2.14(b)(8 and (9)]: $100.
(8) Temporary use of occupiable trailers for construction,
commercial or emergency purposes: $150; multiple units: $75 for each
additional unit.
(9) Annual construction permit [N.J.A.C. 5:23-4:18(a)4]:
$1,000 annually per worker.
(10) Asbestos and lead abatement work: $200.
D. Fire protection subcode fee.
(1) For the installation or replacement of a tank of whatever
description to be used for combustible liquid:
(a)
Tanks up to 1,000 gallons: $75.
(b)
Tanks over 1,000 gallons: $115.
(c)
Abandonment or removal: $75.
(2) For the installation, replacement or conversion of
any fuel-burning equipment, HVAC or A.C. systems: $90. Note: for one-
and two-family see mechanical subcode fee.
(3) Installation or replacement of solid-fuel-burning
appliances to include fireplaces, wood-coal-burning stoves, chimney
stacks, and liners: $60 each.
(4) Installation of clothes dryer, range, stove, exhaust
hood, grill or water heater: $100 each. Note: for one- and two-family
see mechanical subcode fee.
(5) Incinerators and crematoriums: $400 each.

(7) Smoke and heat detectors, horns, strobes, bells, dampers,
pull stations, alarms and electrical devices: one to eight, $60; each
additional eight, $30.
(8) Exit emergency lights, exit discharge lights: one
to five, $60; each additional five, $30.
(9) Sprinkler water main: $150.
(10) For the installation of additional suppression systems,
including, but not limited to Ansul, Halon, CO-2, foam and dry chemical
systems: $100.
(11) Exhaust systems, spray booths, commercial kitchen
and hazardous exhaust hoods: $150.
(12) Elevator recall systems and emergency smoke evacuation
system: $100 each.
(13) For the installation of standpipes: $250 each.
(14) Installation and relocation of private fire hydrants:
$100 each per 100 feet or part thereof.
(15) Installation of emergency standby system: $100 (pre-engineered).
(16) Temporary tent or membrane structures in excess of
120 square feet [N.J.A.C. 5:23-2.14(b): $150.
(17) Minimum fire subcode fee shall be $75.
E. Plumbing subcode fee.
(1) The fee shall be in the amount of $20 per fixture, piece of equipment or appliance connected to the plumbing system and for each appliance connected to the gas piping or oil piping system, except as indicated in Subsection
E(2) and
(3) below.
(a)
Vent stacks; water closets/urinals/bidet; bathtubs;
showers/floor drains; dishwashers/garbage disposals; washing machines/standpipes;
hose bibs; drinking fountains; roof drains/yard drains (except gutters);
sump pump; backflow devices/vacuum breakers; reduced pressure back-flow
devices; indirect connections; hot-water heaters/tankless/storage
tanks; gas appliances/appurtenances; gas heating units/equipment:
$20 each.
(2) The fee for the following special devices shall be
$75 each: grease traps, oil separators, refrigeration units, utility
service, auto rain lawn sensor connections, backflow preventers equipped
with test ports (double check valve assembly, reduced pressure zone
and pressure vacuum breaker backflow preventers), steam boilers, water
boilers (excluding those for domestic water heating consumption),
sewer pumps, interceptors, waterline capping, and fuel oil tank piping.
(3) For cross connections and backflow preventers that
are subject to testing, requiring reinspection annually: for each
device, the fee shall be $75.
(4) Minimum plumbing subcode fee: $75.
F. Mechanical subcode fee R-3/R-4 (one- and two-family).
(1) Inspections of R-3 or R-4 Use Group shall be a flat
rate. No separate fee shall be charged for gas, fuel oil or water
piping connection associated with the mechanical equipment inspected.

(2) For complete installation, replacement or conversion
of heating ventilation/air-conditioning equipment, boilers and furnaces:
$75.
(3) Installation of clothes dryer, oven, range, stove,
exhaust hood, grill: $50.
(4) For installation and replacement of water heaters:
$50.
(5) Minimum mechanical subcode fee: $75.
G. Electrical subcode fee.
(1) Electrical fixtures and devices:
(a)
From one to 50 receptacles, fixtures or switches:
$60.
(b)
Increments of 25 additional items: $30.

Note: For the purpose of computing this fee,
the term "receptacles, fixtures or switches" shall include: lighting
outlets, fluorescent fixtures, intercom devices, light standards,
motors or equipment less than one hp or one kw, smoke and heat detectors,
alarm devices, thermostats and communications outlets.

(2) Motors:

Rated from one hp to 10 hp: $25.
(b)
Greater than 10 hp to less than or equal to
50 hp: $75.
(c)
Greater than 50 hp to less than or equal to
100 hp: $125.

(4) Service equipment, term includes service panel service
entrance and subpanels:

Greater than zero amp, less than or equal to
225 amp: $100.
(b)
Greater than 225 amp, less than or equal to
1,000 amp: $225.
(c)
Greater than 1,000 amp: $700.
(d)
Each permanently installed private swimming
pool, spa, hot tub or fountain shall be a flat fee of $250 for in-ground;
$80 for aboveground.
(e)
For public swimming pools, the fee shall be
charged on the basis of number of fixtures and rating of electrical
devices.
(f)
The fee for the annual electrical inspection
of public swimming pools, spas or hot tubs shall be $150 (bonding/grounding
certificate).
(g)
Minimum electrical subcode fee: $75.
H. Fee reduction.

(1) The
City of Rahway grants a 5% reduction in permit and inspection fees
for seniors and veterans.
(2) In
the event the Mayor declares a state of emergency, the City may grant
a reduction in permit and inspection fees.
The fire limits of the City of Rahway are hereby established pursuant to N.J.A.C. 5:23 as stipulated in Article
II of this chapter.

A. Material lift(s) are defined as any material handling
device designed to pass through a floor, ceiling or fire separation
wall to hoist or convey equipment or other items by means of a power
operated mechanism.
B. All material lifts must comply with the recognized
and recommended standards set forth in the American Society of Mechanical
Engineers Code, as amended and supplemented, which is incorporated
herein by reference, and will be inspected for such compliance at
least once a year.
C. Inspections of material lifts will be performed by
the City of Rahway's authorized elevator on-site inspection agency.
D. The City of Rahway shall charge and collect a fee
for all material lift inspections in accordance with, and not to exceed,
the fees contained in the State Uniform Construction Code Act, N.J.S.A
52:27D-119 et seq., and Part 12 of the Uniform Construction Code,
N.J.A.C. 5:23-12.6(b)(2)(v).

The fire limits of the City of Rahway are hereby established as all those parcels of land lying and being within the limits of Business Zones B-2, B-3 and B-4 and Industrial Zone I, as established by Chapter
421, Zoning, of the Code of the City of Rahway, as amended and supplemented.
