It shall be unlawful for any person to keep any dog or dogs and cat
or cats which, by frequent howling, baying, yelping and screeching, shall
disturb the peace of the neighborhood or constitute a health hazard to the
citizens of the Township of Penn.
A.
No person shall keep or harbor any dog or cat in the
Township so as to create offensive odors, excessive noise or unsanitary conditions
which are a menace to the health, comfort or safety of the public or otherwise
permit the commission or existence of a nuisance as defined hereinafter.
B.
Any dog or cat which by frequent and habitual barking,
howling, screeching, yelping or baying or in any way or manner injures or
disturbs the quiet of any person or the community or which disturbs or endangers
the comfort, repose or health of persons is hereby declared to be committing
a nuisance. It shall be unlawful for any owner or person having custody of
such animal to harbor or permit it to commit such a nuisance.
C.
Any dog or cat which scratches, digs, defecates or urinates
upon any lawn, tree, shrub, plant, building or any other public or private
property other than the property of the owner or person in charge or control
of such animal is hereby declared to be a nuisance.
D.
Restraint required; exceptions.

(1)
No person being the owner or having custody and control of any
dog or animal of the dog kind shall permit the same to be upon any street,
public park, public place, or upon any other private land, except that of
the property owner or on private land owned by another with the express consent
of the property owner, without being effectively restrained from moving by
a chain or leash not exceeding eight feet in length; or other means of restraint
not harmful or injurious to the dog and under the control of a responsible
person capable of physically restraining the dog.

The provisions of this section shall not apply to the ownership
or use of Seeing Eye dogs by blind persons, dogs used in hunting or training
activities or dogs used in police activities of the Township of Penn, such
as the canine corps or tracking dogs used by or with the permission of the
Township Police Department.
E.
Persons with a handicap or disability who rely on specifically
trained guide dogs shall be exempt from the provisions of this section.

An owner of a dog or cat violating any provision of this article shall,
upon conviction before a District Justice, be sentenced to pay a fine of not
more than $600, plus costs, and in default of payment thereof shall undergo
imprisonment for a period not exceeding 30 days.
