A fence, at least four feet two inches high measuring from the surface of the earth and sufficiently close and strong to prevent livestock from escaping, is hereby required throughout the entire Township of South Harrison wherever livestock is kept.
A. 
If any livestock escapes from within the confines of any fence required by § 38-15 of this article it is to be presumed that such fence has not met the provisions of this article
B. 
The owner and tenant, if any, of any property shall be responsible to see that a proper fence, as required, is situated upon any land within the Township of South Harrison wherever livestock is kept.

A. 
For any violation of this article, the property owner, tenant or any other person charged with the care and custody of this property shall, upon conviction, be subject to the penalties provided by § 1-14 of this Code.
B. 
Each and every day that a proper fence is not present shall be deemed a separate violation of this article and punishable accordingly.
