All persons owning property abutting on any street or highway shall erect or construct fences, walls or other safeguards for the protection of persons from injury from unsafe places on the property adjacent to or near such street or highway. Any person, who shall not within 30 days after notice by the Borough Council construct suitable fences, walls or other safeguards as herein provided, shall be subject to the penalties prescribed by §
207-37.

A. No person shall place upon or attach to any Borough property, any
tree, any telephone pole, any electric light pole, any parking meter,
any street sign, or any other structure or any other part of a structure
that is on Borough property or that is within an easement in favor
of the Borough any notice or sign of any kind except such notices
as are required by law to be posted or except as otherwise allowed
by this section.
B. Despite the restrictions set forth Subsection
A hereof, upon compliance with the requirements otherwise set forth in this section, the Administrator shall issue a permit allowing signs that advertise or provide notice of an activity, event, or gathering to be placed on Borough parking meter poles if the activity, event or gathering is to be held within the Borough of Caldwell and is for the benefit of a 501(c) charitable organization, or is for the purpose of collecting donations for a Caldwell resident.
C. Any person seeking to obtain a permit as required by Subsection
A, above, shall file an application for a permit on a form furnished by the Borough Administrator at least 10 days prior to the first day that an advertisement, notice or sign shall be posted.
D. The application shall require that the applicant specify the proposed
locations of the notices or signs to be posted, the number of such
notices or signs to be posted, the size thereof, and the period of
time that the notices or signs will be posted (which shall not exceed
14 days). The application shall further request the name and address
of the person responsible for posting the notices or signs and the
person who will be responsible for removing the notices or signs.
E. The application will require the applicant to provide a copy of the notice or sign to be posted, provide a general description of the activity, event, or gathering to be advertised and provide proof that the activity, event, or gathering meets the criteria set forth in §
207-25B.
F. The applicant shall, upon making application with the Administrator,
deposit $100, by check, payable to the Borough of Caldwell. The Administrator
will return the check to the applicant upon the applicant removing
the notice or sign from the parking meter poles upon the date set
for removal in the application. In the event that the notice or signs
remain after the date or removal set forth in the application, the
Borough Administrator shall negotiate the check on behalf of the Borough,
and the notices or signs will be removed by Borough employees.
G. Despite anything contained in the General Ordinances of the Borough
of Caldwell to the contrary, the Borough Administrator shall, in the
Administrator's sole discretion, determine whether to approve an application
that is submitted pursuant to this section, so as to allow the posting
of notices or signs on parking meter poles. If the Administrator approves
an application, the Administrator shall have sole discretion to determine
the location and the number of notices or signs to be posted.
No person shall scatter or throw upon any of
the streets or other public place within the Borough any handbills,
advertisements, circulars or other written or printed matter; or fasten,
by pasting or otherwise, any such advertisements, notices or circulars
to any of the sidewalks or bridges in the Borough.
No persons shall throw or deposit any ashes,
rubbish, garbage or refuse of any kind in or upon any of the sidewalks,
gutters, streets or public places within the Borough.
No person shall put, place or cause, suffer
or permit to be placed or maintained any showcase or other construction
or device for the display of merchandise or any box, barrel, can,
container, package or thing whatsoever upon or over any sidewalk,
roadway or public place or display or cause, permit or suffer to be
displayed upon or over any sidewalk, roadway or public place any merchandise
for sale or advertisement, provided that this section shall not be
construed to prevent the reasonable use of the sidewalk by the occupant
of any building or part thereof for loading or unloading merchandise,
nor to prevent receptacles for garbage, ashes, refuse or rubbish from
being placed upon the sidewalk, when so placed in accordance with
permission granted by the Borough.

No person shall put, place or throw or cause
or permit to be placed or thrown upon, within or into any street or
public place any building material, poles, lumber, brick, stone, box,
barrel, tile, sand, pipe or any other such substance whereby the safe,
free or unobstructed use of the same by the public in any wise be
impeded or interfered with, provided that permission may be granted
by the Construction Official to deposit building materials on the
streets when he deems that conditions warrant it.

A. No person shall operate or park a vehicle on any street
for the primary purpose of displaying advertising.
B. No person shall park a vehicle on any street or public
place for the primary purpose of sale and distribution of merchandise
or advertising matter.
C. No person shall park a vehicle on the street for the
primary purpose of displaying it for sale.
No person shall negligently or willfully break,
injure or destroy any curb, gutter, crosswalk, bridge or flagging
set or fixed in any public street, sidewalk or place in the Borough.
No person shall put in, upon or over any street
or part thereof any post, porch or shed of any kind whatsoever, except
by permission granted by the Borough Council.
No person shall, without the consent of the
Borough Council, build or construct or permit to be built or constructed
or continue any bay window, store or other window which shall extend
into any public street.
No person shall build or construct or continue
any areaway or cellar opening or entrance over the line of any public
street without providing the same with an iron or other approved suitable
cover resting level with the street when closed, nor build or construct
or continue any such areaway, cellar opening or entrance more than
three feet over the line of any public street.
No person shall erect or construct or permit
to be erected or constructed any gasoline or oil filling station,
pump or other device for the supplying of gasoline, oil or other motor
vehicle fuels or lubricants within the limits of any public street
in the Borough.

Any violation of this article shall be punishable
by a fine not exceeding $2,000, imprisonment for a term not exceeding
90 days, a period of community service not exceeding 90 days, or a
combination thereof.
