A. 
Lawful parking on the streets of the Borough of Caldwell and in parking lots maintained by the Borough of Caldwell shall be allowed in accordance with the regulations prescribed herein. The provisions of this article imposing restrictions on parking shall not relieve any person of the duty to observe other and more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in N.J.S.A. 39:4-138 or any other New Jersey statute or as hereinafter provided.
B. 
Unless specifically set forth in another section of this chapter, any person who causes, allows, or permits any vehicle registered in the name of such person to be parked in a manner so as to violate any section of this chapter shall be fined not less than $35 nor more than $500 for each such violation. A separate violation of this chapter shall be deemed to have occurred for every calendar day that a vehicle is parked in violation of any section of this chapter.

C. 
"Senior citizen" defined. For purposes of this chapter, a "senior citizen" shall be defined as any individual who reaches the age of 62 during the then-current calendar year.
D. 
Sundays and holidays. For purposes of this chapter, whenever enforcement of a regulation is suspended on a Sunday or holiday, the suspension shall be between the hours of 6:00 a.m. and 12:00 midnight on the Sunday or holiday. Despite anything contained in this chapter to the contrary, all regulations shall remain in effect until 6:00 a.m. on all Sundays and holidays.
A. 
The Chief of Police may identify permitted parking areas by markings or other means as he/she deems appropriate to permitted parking areas. When installed, no person shall park any vehicle across any such line or marking or space or park any vehicle in such position that it shall not be entirely within the area so designated by such lines or markings.
B. 
It shall be unlawful and a violation of the provisions of this section for any person to deface, injure, tamper with, or willfully destroy or impair the usefulness of any marking installed under the provisions of this chapter.
C. 
Any person violating the provisions of Subsection B of this this section shall, upon conviction thereof, be punished by a fine not to exceed $500 or by imprisonment in the Essex County jail for a period not to exceed 90 days, or by both such fine and imprisonment.

Except as provided in § 230-33 of this chapter, overnight parking on all streets in the Borough is prohibited.
The Chief of Police hereby is authorized and directed to set aside and designate permit parking spaces, by permit type, in certain sections in each of the following municipal parking lots in the Borough:

A. 
The Chief of Police shall have the authority to classify permits by parking lot and by permitted hours of parking. Permit type shall be distinguished by lettering, as determined by the Police Department. Each permit shall authorize the person to whom it is issued to park a designated motor vehicle in the permit parking spaces in a designated parking lot, as set forth in this chapter, during the hours when vehicles may be legally parked in such municipal parking lots. Every person obtaining a permit shall display the permit in the authorized vehicle in a place and manner as directed by the Chief of Police at the time the permit is issued.
B. 
Parking permits shall be valid for a period of up to one calendar year from the day issued but may be issued on a quarterly basis.
C. 
The permits issued pursuant to this section shall be as follows:
(1) 
Residential day. A residential day permit shall entitle the holder thereof to park the registered vehicle in an assigned spot or location, as the Police Chief shall direct, between the hours of 8:00 a.m. and 6:00 p.m., seven days a week.
(2) 
Residential night. A residential night permit shall entitle the holder thereof to park the registered vehicle in an assigned spot or location, as the Police Chief shall direct, between the hours of 6:00 p.m. and 6:00 a.m., seven days a week.
(3) 
Residential commuter. A residential commuter permit shall entitle the holder thereof to park the registered vehicle in an assigned spot or location, as the Police Chief shall direct, between the hours of 6:00 a.m. and 2:00 a.m. Monday through Friday, holidays excepted. For purposes of this Subsection C(3), "Friday" shall include the hours between 12:00 midnight on Friday and 2:00 a.m. on the following Saturday morning.
(4) 
Merchant employee. A merchant employee permit shall entitle the holder thereof to park the registered vehicle in an assigned spot or location and during such hours as the Police Chief shall direct.
D. 
Despite the foregoing provisions of this section, Borough residents may purchase from the Caldwell Police Department temporary overnight parking permits for the sum of $5 per night (or such higher fee determined by the Police Department after a public hearing conducted upon prior notice to the Borough Council). Permits shall be in the form determined by the Chief of Police, and each permit shall allow the permit holder to park an automobile in any lot in the Borough during the hours of 2:00 a.m. through 6:00 a.m.
E. 
The sections of the foregoing parking lots designated for permit parking shall be so marked by the Chief of Police. At each space so marked, it shall be unlawful to park any vehicle in such a way that said vehicle shall not be entirely within the limits of the space so designated.
F. 
In no event shall a vehicle that is parked in a parking spot by permit remain in the parking spot beyond the time for which the permit is issued.
A. 
The Chief of Police hereby is authorized to issue permits to persons for the parking of vehicles in the permit parking spaces in the parking lots named in this chapter, but there shall not be issued at any one time a greater number of permits for any one of the aforementioned parking lots than the number of permit parking spaces set aside and designated by the Chief of Police for such parking lots. No person shall be issued a permit for any vehicle that is not legally registered and legally insured, nor shall any person be issued a permit if the Chief of Police determines in accordance with regulations established by the Chief of Police that a permit should not be issued.
B. 
Despite anything in this chapter to the contrary, no permit shall be issued pursuant to this section to any commercial vehicle unless the commercial vehicle is owned and operated by an individual or business having a main business address in the Borough.
A. 
The Chief of Police shall collect all parking permit fees in advance of issuing any permit. The Chief of Police is not authorized to refund all or any part of any permit fee for any reason.
B. 
There shall be a fee of $90 per quarter for each residential day, residential night, residential commuter and merchant employee parking permit issued in accordance with this section, except that the fee for a senior citizen who purchases any such permit for personal use shall be $85 per quarter.
C. 
Despite the fees set forth in the preceding subsection, there shall be a fee of $45 per quarter for merchant employee permits issued in accordance with this section for the Smull Avenue lot.
A person to whom a parking permit other than a merchant employee permit has been issued pursuant to this section may transfer the permit from one vehicle to another vehicle owned by the same person at any time during the period for which the permit is issued, subject to the approval of the Chief of Police. There shall be a fee of $5 payable to the Chief of Police for each such transfer.
Every vehicle parked in any permit parking space shall be parked within the space marked upon the pavement for the parking of a single motor vehicle.
A. 
Any vehicle that is parked without a valid permit in an area designated for permit parking, contrary to the provisions of this article, may be towed and removed by the police, and all costs of such towing, removal and storage shall be paid by the owner of the vehicle.
B. 
No person shall cause, allow or permit any vehicle registered in the name of or operated by such person to be parked for longer than three hours in any municipal parking lot at any time between the hours of 6:00 a.m. and 6:00 p.m., Monday through Saturday, unless a parking permit otherwise authorizing parking has been obtained and is displayed in accordance with regulations established by the Chief of Police.
C. 
No person shall cause, allow or permit any vehicle registered in the name of or operated by such person to be parked between 8:00 a.m. and 6:00 p.m. in a municipal parking lot space designated for day permit parking, or between 6:00 p.m. and 6:00 a.m. in a municipal parking lot space designated for night permit parking, unless the person has first obtained the appropriate parking permit allowing parking during such period and has properly displayed the permit in accordance with the regulations established by the Chief of Police.
D. 
Despite anything contained herein to the contrary, no person shall cause, allow or permit any vehicle registered in the name of or operated by such person to be parked in the Provost Square parking lot between the hours of 10:00 p.m. and 5:00 a.m. or for more than three hours between the hours of 5:00 a.m. and 10:00 p.m.
E. 
Despite anything contained herein to the contrary, no person shall cause, allow or permit any vehicle registered in the name of or operated by such person to be parked in the same parking spot for more than three hours between the hours of 6:00 a.m. and 10:00 p.m. unless such person has first obtained a Borough employee parking permit from the Chief of Police.

A. 
Despite anything contained in § 230-30 to the contrary, a person wishing to park a vehicle on the portion of a street where parking is otherwise limited to three consecutive hours for a period longer than three consecutive hours may do so provided:
(1) 
The person resides on the street and within the block where parking is restricted;
(2) 
The person obtains a permit from the Chief of Police for such parking.
B. 
Permits issued pursuant to this section may be obtained only by a person who resides in a residential unit within the block where parking is limited to three hours in accordance with § 230-30.
C. 
There shall be no more than one permit issued to each residential unit. Permits are not transferrable from person to person or vehicle to vehicle.
D. 
Permits shall allow the vehicle on which the permit is affixed to be parked pursuant to this section only in the block where the person who obtained the permit resides.
E. 
Permits shall be in the form of a decal. The decal shall identify the block in which the vehicle may be parked in accordance with this section.
F. 
The person to whom a permit is issued shall place the permit on a driver's side window on the person's vehicle.
G. 
Nothing in this section shall be deemed to allow a vehicle to be parked in a manner or for a time that violates any other section of this chapter or that violates any other Borough ordinance.
H. 
Permits shall be valid for up to one full year from the date of issuance.
I. 
There shall be a fee of $5 for each permit issued.

A.

All municipal parking lots shall contain parking spaces designated as restricted parking spaces for use by persons who have been issued special vehicle identification cards by the New Jersey Motor Vehicle Commission. The number of reserved spaces and their specific locations shall be determined by the Chief of Police in accordance with all applicable legal requirements, including the requirements of N.J.S.A. 52:32-12. The Police Department shall erect or install in all municipal parking lots and parking decks proper signs calling attention to the provisions of this section.

Smull Lot
Four located as follows:
One immediately to the southwest of the exit lane from the lot to Smull Avenue
One immediately to the northwest of the exit lane to Smull Avenue
Two adjacent to one another at the southwesterly end of the center strip of parking spaces with an eight-foot-wide access aisle between them.

Despite anything contained in this chapter to the contrary, a person who owns property on Hanford Place shall be entitled to obtain a permit to allow that person to park a vehicle on Hanford Place in a metered parking spot without payment of the meter fee, provided the person obtains a permit from the Chief of Police for such parking and displays that permit in accordance with the terms of this § 230-34.
A. 
Permits issued pursuant to this section may be obtained only by the owner of the property on Hanford Place, or the owner's designee. One permit shall be available to a property owner for each residential unit owned by the property owner on Hanford Place.
B. 
Permits shall be in the form of placards. The placard shall identify the property address of the property owner to whom the permit was issued.
C. 
The placard shall be in clear display, hung from the rear view mirror. Failure of a permit holder to display the placard in the manner required herein will disqualify the permit holder from the parking meter exemption provided in this section.
D. 
Permits can be transferred from vehicle to vehicle by the person possessing a permit.
E. 
Nothing in this section shall be deemed to allow a vehicle to be parked in a manner or for a time that violates any other section of this chapter or that violates any other Borough ordinance.
F. 
Permits shall be valid for up to one full year from the date of issuance.
G. 
There shall be a fee of $5 for each permit issued.
