Whenever used in this article, unless a different meaning clearly appears from the context, the following terms shall have the meanings indicated:
BOROUGH
The Borough of Carteret.
BUILDING
Any premises occupied by commercial, industrial or residential tenants.
COLLECTOR
Any person privately engaged or employed by the Borough in the business of collecting garbage, refuse or rubbish.
GARBAGE
Putrescible animal and vegetable wastes from the handling, preparation, cooking and consumption of food.
HAZARDOUS MATERIALS
Those materials requiring special handling techniques due to the potential dangers caused by their inherent toxicity, breakage, consumption and/or illegal use, i.e., paints, chemicals, hydrocarbons and/or their derivatives, refuse pharmaceuticals and discarded syringes, cathode ray tubes, fluorescent bulbs, etc.
PERSON
Includes individuals, partnerships, public or private corporations or associations of persons, owners, tenants, agents or lessees.
RECEPTACLE, METAL
A metal container, with handles, having a tightly fitting cover, which shall not exceed a capacity of twenty (20) gallons and shall have been originally designed and manufactured for the purpose of retaining garbage.
RECEPTACLE, PLASTIC
A plastic container, with handles, having a tightly fitting cover, which shall not exceed a capacity of thirty-two (32) gallons.
RECEPTACLE, PLASTIC BAG
A flexible plastic sack of a minimum of three (3) mils thickness and so constructed to be capable of being tied or fastened at the top so as to prevent spillage and/or leakage of its contents.
REFUSE
All putrescible and nonputrescible solid wastes, except body wastes, including cans, glasses, bottles, crockery, household sweepings and other items of a similar facsimile, usually of a noncombustible nature.
RUBBISH
Nonputrescible solid wastes, including paper, cardboard, excelsior, straw, boxes, crates, garden and lawn clippings, wood and materials of a similar facsimile, usually of a combustible nature.
No person shall dispose of, deposit or throw garbage, refuse or rubbish or any other materials upon or along any public or private highway, road or street or upon public or private property or any river, stream or body of water within the Borough.
A. 
All garbage, refuse and rubbish included for collection by the Borough or a private collector shall be deposited in receptacles and placed along the curb for collection not sooner than one (1) hour before sunset of the day prior to the scheduled collection in residential areas and, in commercial areas, not sooner than 5:30 p.m. of the day prior to the scheduled collection and removed by 12:00 noon of the following day. All wood and branches which cannot be placed in a receptacle shall be securely tied together in lengths not to exceed four (4) feet and not exceeding seventy-five (75) pounds in weight.
B. 
In any building occupied by more than one (1) tenant, the owner thereof shall be responsible to see that proper receptacles are used, placed on the curb and removed as so required and that all other provisions of this article are conformed to.
No person shall privately collect or transport any garbage, refuse or rubbish within the Borough except in compactor-type collection units. All vehicles used shall at all times be subject to inspection and approval by the Borough's Health Officer or his designee and shall be kept and maintained in a clean and sanitary condition and in good working order.
All garbage, refuse or rubbish collected and transported within the Borough which shall spill or fall while being carried or conveyed to a truck or other collection vehicle or container shall be immediately removed and broom-cleaned so as to leave the premises or street in a clean condition.
No person other than the owner or authorized collector of the Borough shall interfere with or disturb any garbage, refuse or rubbish after it has been placed in a receptacle or properly tied together and placed on the curb for collection.
All owners of vacant lots shall keep the premises free from garbage, refuse or rubbish.
Hazardous materials, as defined by this article shall not be placed in receptacles but shall be removed by appointment through a special collection. All hazardous materials shall be securely wrapped and tied to prevent breakage during collection.

A. 
The Director of the Department of Public Works shall have the power to establish proper rules and regulations covering the collection of garbage, refuse and rubbish not inconsistent with the provisions of this article and to fix the time for such collections and to change the time of such collections whenever, in his judgment, such change shall be necessary or advisable.
B. 
Anyone dropping off items at the Borough of Carteret Recycling Center will be required to present a valid driver’s license or other proof of Borough residency.
C. 
There will be a fee charged for special handling or pickup of bulk waste items such as appliances, washing machines, dryers, refrigerators, humidifiers, denumidifiers, stoves, dishwashers, air conditioners, microwaves, water coolers and other such items. The fee charged will be $10 per item, except that no fee will be charged if the resident drops off the item at the recycling center.
D. 
There will be a fee charged for special pickup of bulk waste such as furniture, waste building material from construction, remodeling, repair and demolition operation on houses, buildings and other structures by residents. The fee will be $20 per cubic yard; less than two cubic yards will be free. If work is done by a contractor, the contractor is responsible for removal of waste. Penalties provided for, pursuant to this chapter, shall be applicable if such work is actually performed by a contractor and a resident disposes, or attempts to dispose of, the resultant waste through the municipal collection system, the Public Works Department or the recycling center.
E. 
Dirt, sand, or other soil material will not be collected by the Borough and any used oil, or other such hazardous materials, shall not be dropped off at the recycling center.
F. 
There will be a fee charged for bulk items of concrete, asphalt, bricks, blocks, and/or stone. Up to one cubic yard (four sidewalk slabs) will be free. Anything above this amount shall be $75 per truckload or eight cubic yards.
G. 
No municipal collection shall be provided to any industrial or commercial businesses, which shall be required to dispose of their garbage, rubbish and refuse through the use of their own dumpsters, or other containers, at their sole cost and expense.
H. 
With regard to the disposal of any material requiring the payment of a fee and/or other Borough approval or pickup scheduling, application therefor and proof of such payment and/or approval shall be obtained through the Borough Clerk’s office, the Board of Health, and/or the Department of Public Works, or their respective designees, as determined by the Mayor, by executive order.
The enforcing agencies of this article will be the Board of Health, the Superintendent of Streets and Roads and the Borough of Carteret Police Department.

Any person who violates any provision of this article shall, upon conviction thereof, be subject to the penalties set forth in § 1-17 of this Code.
