[HISTORY: Adopted by the Borough Council of the Borough of Carteret
12-15-1970 as Sec. 7-13 of the 1970 Revised Ordinances, as amended through
3-5-1974. Section 191-5 added at time of adoption of Code; see Ch. 1, General
Provisions, Art. I. Other amendments noted where applicable.]
No person shall operate a pool or billiard parlor in the borough without
having first obtained a license and paid the required fee.

The license fee for pool and billiard parlors shall be fifty dollars
($50.) for the first table and ten dollars ($10.) for each additional table.
The application for license shall state the number of tables which will be
used.
A.
This chapter shall not apply to a pool or billiard table
in a private residence used solely by the occupants of the house and their
guests.
B.
This chapter shall not apply to a bona fide social club,
golf club, field club, religious, charitable, benevolent, fraternal or other
nonprofit organization having a membership in excess of twenty-five (25) which
has pool or billiard tables solely for the recreation and amusement of its
members, provided that the organization files with the Clerk on a form provided
by him a claim for exemption and a statement of the facts upon which the claim
is based.
The following regulations shall apply to all licensed pool and billiard
parlors:
A.
Hours of operation. No pool or billiard licensee shall
operate any pool or billiard facility on any day between the hours of 2:00
a.m. to 6:00 a.m., except Saturday and Sunday. On Saturday a licensee shall
not operate between 3:00 a.m. and 6:00 a.m.; on Sundays between 3:00 a.m.
and 1:00 p.m.

B.
Minors. No minors shall be allowed on the premises after
12:00 midnight of any day.

C.
Card playing; gambling. No card playing shall be permitted
on premises licensed under this chapter, even if card playing is for social
purposes. No dice throwing, crap shooting, gambling or disorderly conduct
of any nature shall be permitted on the premises.
D.
Outside view of premises. All premises where pool and
billiards are played shall be so arranged and so lighted that a full view
of the interior may be had from an adjacent public thoroughfare or from adjacent
rooms to which the public is admitted at all hours.
E.
Location restrictions. No pool or billiard parlor shall
be operated within two hundred fifty (250) feet of any public or parochial
school or any church or place of worship or their surrounding premises.

Any person who violates any provision of this chapter shall, upon conviction thereof, be subject to the penalties set forth in § 1-17 of this Code.
