This chapter shall be known as "Authorizing the Issuance of Appearance Tickets by the Public Servants of the Town of Rhinebeck Under Local Law No. 2, 2000."
The purpose of this chapter is to authorize certain public servants of the Town of Rhinebeck to issue and serve appearance tickets in connection with violations of state statutes, local laws, ordinances, or rules and regulations of the Town of Rhinebeck which the public servants are authorized or required to enforce.
A. 
The following public servants of the Town of Rhinebeck are hereby authorized to issue and serve appearance tickets with respect to violations of state statutes, local laws, ordinances, rules or regulations of the Town of Rhinebeck that such public servants are required or authorized to enforce:
(1) 
Building inspector.
(2) 
Deputy Building Inspector.
(3) 
Assistant Building Inspector.
(4) 
Zoning Officer.
(5) 
Enforcement Officer.
(6) 
Fire Inspector or Fire Marshal.
(7) 
Animal Control Officer and Assistant Animal Control Officer.
B. 
Additions or deletions to the list of those public servants of the Town of Rhinebeck authorized to issue and serve appearance tickets may be made by the Town Board when deemed necessary.
Such public servants shall have the right to issue appearance tickets and any other duly authorized procedures, unless otherwise revoked, modified or restricted by the Town Board for the enforcement of the provisions of this chapter.
As used in this chapter, the following terms shall have the meanings indicated:
APPEARANCE TICKET
Shall have the same definition as provided in Article 150, et seq, of the Criminal Procedure Law of the State of New York, and the procedures governing its use shall conform in all respects to these procedures as set forth in said Article 150 of the Criminal Procedure Law of the State of New York and other applicable articles of that law.
The authority to use appearance tickets returnable in the Town Justice Court shall not infringe upon the authority of the aforementioned public servants to use any alternative methods of enforcing the statutes, local laws, ordinances, rules or regulations of the State of New York and the Town of Rhinebeck, as may be provided by law.
It shall be the duty of such public servants to keep a record of any and all appearance tickets or other documents that may be issued pursuant to this chapter.
