To prevent water damage from blocked drainage ditches, any development by and for an individual on private property can not disrupt existing drainage ditches and must be treated by the landowner under the following conditions:
A. 
[1]Application shall be made to the Town of Hague Superintendent of Highways for permission to place improvements through or over drainage ditches; and

B. 
The Town of Hague Superintendent of Highways shall be consulted for technical information regarding Town of Hague standards for proper sizing and installation of culverts or other structures that prevent the disruption of drainage.
Any person committing an offense against any provision of this chapter shall, upon conviction, be guilty of a violation pursuant to the Penal Law of the State of New York, punishable by a fine not exceeding $250 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The continuation of an offense shall constitute, for each day the offense is continued, a separate and distinct violation.
