This article shall be referred to as the "Town of Newfane Winter Parking Ordinance."
The purpose of this article is to prohibit the parking of vehicles during winter months for snow removal and to authorize the Highway Superintendent to remove vehicles that are in violation of the prohibited winter parking from the Town highways.
As used in this article, the following words and phrases shall have the meanings indicated:
RIGHT-OF-WAY
Includes all portions of Town highways owned or maintained by the Town or used for public travel, including but not limited to shoulders, ditches, culverts and bridges.
VEHICLE
Every device in, upon or by which any person or property is or may be transported or drawn upon a highway, including licensed or unlicensed vehicles, except any devices which are moved by human power or used exclusively on rails.
No vehicle shall be allowed to park on any Town highway or right-of-way between the hours of 2:00 a.m. and 6:00 a.m. from November 15 to April 1.
The Highway Superintendent shall have the power to cause the removal of all vehicles in violation of this article.
Where any vehicle is removed by the Highway Superintendent under this article with Town equipment, the owner shall be charged with the cost of removal, disposition and storage of said vehicle. The schedule of such cost is to be fixed from time to time by the Town Board.
It shall be the duty of the Highway Superintendent or other designated officials to submit reports to the Commissioner of Motor Vehicles under any applicable provisions of the Vehicle and Traffic Law of the State of New York.
If a vehicle is in the Town's possession for more than 30 days and is unclaimed, then the Town Superintendent of Highways or other designated officials may sell the vehicle at public auction upon notice conspicuously posted in three public places within the Town at least six days before the date of said sale. Any official conducting the sale may, in his discretion, give other publicity to the sale or delay the sale in the interest of justice.
Any violations of this article shall be deemed traffic infractions under the Vehicle and Traffic Law. Each violation of this article shall be punishable by a maximum fine of $50 for each and every violation thereof.
