The position of Special Code Enforcement Officer is hereby created and shall hereafter be designated as the "Special Code Enforcement Officer of the Borough of Eatontown."
The Special Code Enforcement Officer shall be appointed by the majority vote of the governing body and shall hold the office until December 31 of the year of said appointment. Any vacancy in said office shall be filled by the governing body for the unexpired portion of such term. The Special Code Enforcement Officer shall be chosen by the governing body on the basis of his qualifications, with special reference to his actual training and/or experience in the field of special law enforcement and his familiarity with the statutes, codes, ordinances and resolutions of the State of New Jersey and the Borough of Eatontown governing the same. In some cases the Special Code Enforcement Officer may be designated to augment and assist in the enforcement of ordinances already enforced by a separate designated official or position created by the Borough of Eatontown.
The salary of the Special Code Enforcement Officer shall be established by a majority vote of the governing body prior to the beginning of each term.
The Special Code Enforcement Officer shall be responsible to the governing body for the proper administration of his position and to that end, he shall be responsible for the implementation and enforcement of all ordinances related to property maintenance, snow removal, local litter and garbage ordinances, shopping cart ordinances, abandoned vehicles and personal property and other ordinances so designated by the Borough Council and delegated by the Zoning Official or other officials which do not require special licensing or certification not already held by the party appointed as Special Code Enforcement Officer.[1]

Nothing herein contained shall derogate from or authorize the Special Code Enforcement Officer of the Borough of Eatontown to exercise the powers and duties of any elected official of the Borough of Eatontown and the boards, bodies and commissions thereof established pursuant to law or to act in a police officer capacity that would normally require special training in the use of firearms.
