No person or persons, firm or corporation shall
engage in or carry on any business in the Borough of Eatontown nor
aid or assist as employees, clerks or otherwise in carrying on such
business or in using any wagon, vehicle, stand, store or other place
or thing nor sell or offer for sale any goods or things for which
a license is required by the terms of this chapter, unless a license
as herein provided for shall have been first obtained therefor.
Application for a license shall be made to the
Clerk of the Borough of Eatontown within 30 days after the effective
date of this chapter.
All license fees shall be due and payable to
the Clerk on the first day of January of each year, the term thereof
commencing on January 1 and expiring on December 31 thereafter.

The license fees to be paid annually as above provided to the Borough of Eatontown for conducting any business, trades, professions or occupations in the Borough of Eatontown shall be $100 as an initial fee and $75 thereafter on an annual basis. No person shall be required to obtain a license or pay the license fee herein provided under this chapter to engage in or carry on any business where the state has already issued a license to such person for activities. The holder of any such state license shall, in lieu of the provisions of §§
198-2 and
198-3 of this chapter, present proof to the designated Code Enforcement Officer of the Borough of Eatontown of the existence of said state license and its annual continued effectiveness. Should any person or persons, firm or corporation who has had a license which is subject to renewal as set forth in §
198-3 fail to renew his or her license by January 31 of any given year, the prior license holder shall be subject to a late fee upon renewal of $25, renewal of said license of which shall be subject to payment of said late fee in addition to the annual license fee. The aforesaid late fee is in addition to any other sanctions or penalties allowed under this chapter for violation of any provision of this chapter.
The Zoning Officer, the Building Inspector or
any other Borough officer designated by the Mayor and Council may
be and is hereby authorized and directed to enforce this chapter.
For the purpose of this chapter, the terms used
herein are defined as follows:
BUSINESS
Includes businesses, trades, call-ins, professions and vocations.
PERSON
Includes persons, firms, copartnerships and corporations.

Any person, firm or corporation violating any
provision of this chapter shall, upon conviction, be subject to a
fine not exceeding $1,250, a term of imprisonment not exceeding 90
days or a period of community service not exceeding 90 days, or any
combination thereof.
