This chapter provides for the administration
and maintenance of vacant parcels of land, multifamily premises, commercial
premises and single-family residences located in the Village of Rouses
Point in conformity with the provisions of this chapter so as to establish
reasonable safeguards for the safety, health and welfare of the occupants
and users thereof and of the general public.
For the purposes of this chapter, the following
terms shall have the meanings indicated:
COMMERCIAL PREMISES
A building, structure or land used for any purpose other
than for single-family or multifamily purposes, including premises
used for retail purposes, business purposes or industrial purposes.
MULTIFAMILY PREMISES
Any building which is used as a home or residence, other
than a single-family residence, together with any garage or other
accessory building and the lot upon which such building or buildings
are constructed.
SINGLE-FAMILY RESIDENCE
A building which is occupied exclusively as the home or residence
of a single family, together with any garage or other accessory building
and the lot upon which such building or buildings are constructed.
VACANT PARCELS
A parcel of land with no buildings or structures located
on same.

A. All exterior exposed surfaces not inherently resistant to deterioration
shall be repaired, coated, treated or sealed to protect them from
deterioration or weathering.
B. The foundation walls of every building shall be maintained in good
repair and shall be structurally sound.
C. Exterior walls, roofs and all openings around doors, windows, chimneys
and other parts of a building shall be so maintained as to keep water
from entering the building and to prevent undue heat loss from occupied
areas. Materials which have been damaged or show evidence of dry rot
or other deterioration shall be repaired or replaced and refinished
in a workmanlike manner. Exterior walls, roofs and other parts of
the building shall be free from loose, improperly secured and unsecured
objects and material. Such objects or materials shall be removed,
repaired or replaced.
D. The owner of a vacated building shall take such steps and perform
such acts as may be required of him from time to time to ensure that
the building and its adjoining yards remain safe and secure and do
not present a hazard to adjoining property or to the public.
E. All graffiti or defacing shall be removed and the surface finish
restored within a five-day period.
F. Buildings and structures shall be maintained in such a condition so that they shall not become unoccupied hazards, as defined below, or an unsafe building pursuant to Chapter
72, Article
VII, of this Code.
(1) An "unoccupied hazard," for purposes of this subsection, shall be
defined as any building or part thereof which is unoccupied with either
doors, windows or other openings broken, removed or boarded or sealed
up, or any building under construction upon which little or no construction
work has been performed for a period of more than six months.
Whenever the Code Enforcement Officer or enforcement
official finds that an emergency exists which requires immediate attention
to protect the public health or safety, he may, without notice or
hearing, issue an order reciting the existence of such emergency and
requiring that such action be taken as he deems necessary to meet
the emergency. Notwithstanding any other provisions of this chapter,
such order shall take effect immediately. Any person to whom such
order is directed shall comply therewith immediately but, upon petition
to the Code Enforcement Officer or the local Justice Court, shall
be afforded a hearing as soon as possible. After such hearing, the
Code Enforcement Officer or court shall continue such order in effect
or shall modify or withdraw it.
