The purpose of this article is to recruit the
best qualified persons for all positions while maintaining the highest
ethical standards and avoiding even the appearance of impropriety.
In accordance with the intent of the New Jersey Local Government Ethics
Law (N.J.S.A. 4OA:9-22.1), this article sets forth the official policy
of the Township of Franklin regarding the employment of relatives.
This policy is not for the purpose of depriving any citizen of an
equal chance for employment with the township but is solely intended
to eliminate the potential for preferential treatment of the relatives
of governmental personnel.
As used in this article, the following terms
shall have the meanings indicated:
RELATIVE
A.
Affinity in first degree: spouse, spouse's mother,
spouse's father, spouse's sister, spouse's brother, spouse's son and
spouse's daughter.
B.
Consanguinity in first degree: mother, father,
son, daughter, sister and brother.
C.
Consanguinity in second degree: grandmother,
grandfather, aunt, uncle, nephew, niece, granddaughter and grandson.
D.
Any person residing in the same household.
SUPERVISOR
Any employee of the township having authority to hire, transfer,
suspend, lay off, recall, promote, discharge, assign, reward, evaluate
the performance of, or otherwise discipline, or having responsibility
to direct employees, or to adjust their grievances, or effectively
to recommend any of the above actions regarding employees within their
respective department of the township.
The following shall apply in the hiring and
promotion of employees to employment positions for the Township of
Franklin:
A. Relatives of elected officials. No person who is a
relative of any elected official of the Township of Franklin shall
be considered for employment as an employee of the township. This
shall not restrict nor prohibit the continued employment of individuals
to a position or positions with the township where a relative of an
employee is elected as a Township Committee person after the date
of the employee's start of employment with the township.
B. Relatives of Township Administrator. No person who
is a relative of the Township Administrator shall be considered for
employment as an employee of the township. This shall not restrict
nor prohibit the continued employment of individuals to a position
or positions with the township where a relative of an employee is
appointed the Township Administrator after the date of the employee's
start of employment with the township.
C. Promotion of existing employees. No elected official
or supervisor in a department may participate in the promotion process
or reassigning process in that department of any existing employee
who is a relative of such elected official or supervisor. Such elected
official or supervisor shall abstain from participation in such personnel
action as it applies to such relative.
D. Supervision. No relative (as defined in this article)
of a supervisor shall be considered for employment by the Township
of Franklin in the same department or in the case of an existing employee
assigned to a position where that person will be the supervisor of
or be supervised by another relative who is an existing employee within
the same department.
E. Applications. Applications for employment submitted
by relatives of elected officials will not be accepted. Applications
for employment submitted by relatives of supervisors will not be accepted
for positions in the same department in which the supervisor works
or where, through promotion, such a situation or relationship could
exist.
Except as may be otherwise expressly provided
for herein, this article shall not affect the employment of any present
township employees and/or any existing contractual obligations with
employees of the Township of Franklin.

The Employee Handbook, dated January 1, 2020,
is adopted and shall be kept on file in the office of the Business
Administrator. The Employee Handbook shall be available to any full-
or part-time employee to read, and all full- or part-time employees
shall be expected to adhere to its policies and procedures.

The Controlled Substances and Alcohol Use and Testing Policies,
dated January 1, 2020, is adopted and shall be kept on file in the
office of the Business Administrator. The Controlled Substances and
Alcohol Use and Testing Policies shall be available to any full- or
part-time employee to read, and all full- or part-time employees shall
be expected to adhere to its policies and procedures.
