A. Roadside stands shall only be permitted within the Township
of Franklin for the sale and display of produce ("produce" being defined as
any and all plants, flowers, shrubs, trees, bushes, fruits, vegetables or
any other type of plant life) by the owners or the lessees of the premises
at which the roadside stands are situated. Said roadside stands and produce
shall be located no closer than 30 feet from the street line.
B. In the Pinelands Area of the township, "roadside stand" shall mean agricultural commercial establishment (see Chapter
253, Land Development).
It shall be the responsibility of each owner and lessee desiring to
operate a roadside stand within the Township of Franklin to obtain a permit
from the Clerk of the Township of Franklin within 30 days of the passage of
this chapter. There shall be no permit fee charged relative to the issuance
of a roadside stand permit.
Any person operating a roadside stand in violation of this chapter may,
upon conviction thereof before the Municipal Judge, be fined not more than
$500 or be confined in the County Jail for not more than 90 days, or both,
in the discretion of the Municipal Judge, and each day that such violation
continues shall constitute a separate offense.
