[HISTORY: Adopted by the Governing Body of
the Town/Village of East Rochester 2-9-1983 by L.L. No. 2-1983 as

There is hereby designated, in the Town/Village
of East Rochester, a public official to be known as the "Building
Inspector," who shall be appointed by the Town/Village Board of Trustees
of the Town/Village of East Rochester, serving pursuant to the civil
service list and at a compensation to be fixed by the Town/Village
Board of Trustees. It shall be his duty to administer and enforce
the provisions of all laws, ordinances, rules, regulations and orders
applicable to the location, design, materials, inspection, alteration,
repair, equipment, maintenance, use, occupancy, removal and demolition
of buildings and structures and their appurtenances located in the
Town/Village of East Rochester and to perform such other duties as
may be assigned to him by the Board.
A.
The Building Inspector shall have all the powers relating
to the administration and enforcement of the State Uniform Fire Prevention
and Building Code, as now existing and hereafter amended, and any
and all other laws, ordinances and regulations applicable to the construction,
alteration, repair, removal and demolition of buildings and structures
and the installation and use of materials and equipment therein and
the location, use, occupancy and maintenance thereof.

B.
He shall receive and review all applications for the
erection of or additions or alterations to buildings or structures
or other attachments to real property or parts thereof in the Town/Village
of East Rochester and present the same to the Zoning Board of Appeals
for its approval; and thereafter shall issue the permits for the erection
of or additions or alterations to such buildings, structures or other
attachments to real property or parts thereof in the Town/Village
of East Rochester. He shall also issue permits for the removal and
demolition of buildings or structures.

C.
He shall issue all appropriate notices or orders to
remove illegal or unsafe conditions and to do any and all things necessary
or desirable in his judgment in connection with the carrying out of
his duties.
D.
Whenever he shall deem it necessary or appropriate,
he may require the performance of tests in the field by experienced
professional persons or by an accredited and authoritative testing
laboratory or service bureau or agency, first submitting such request
to the Town/Village Board of Trustees for its prior approval.
E.
The Building Inspector shall also have the following

The Building Inspector may request and shall
receive, as far as may be necessary in the discharge of his duties,
the assistance and cooperation of the Police and Fire Departments
and of all municipal officials exercising any jurisdiction over the
construction, use or occupancy of buildings or the installation of
equipment therein.
A.
The Building Inspector shall keep permanent official
records of all transactions and activities conducted by him, including
all applications received, permits and certificates issued, fees charged
and collected, inspection reports and notices and orders issued. All
such records shall be public records open to public inspection during
business hours.
B.
The Building Inspector shall, annually, submit to
the Board of Trustees a written report and summary of all business
conducted by him, including permits and certificates issued, fees
collected, orders and notices promulgated, inspections and tests made
and appeals or litigation pending.
In the absence of the Building Inspector, or
in the case of his disqualification or inability to act, the Mayor
shall have the power, with the consent of the Board of Trustees, to
designate a person to act in his behalf and to exercise all the powers
conferred upon him by this chapter during such absence, disqualification
or inability to act.
