It is the policy of the Village of Hastings-on-Hudson to provide for a Planning Board with the scope and authority to adequately protect and provide for the reasonable development of all tracts of land within the geographical confines of its village. The means to accomplish this orderly, efficient and economical development of land is through the effective appointment and utilization of its Village Planning Board. Pursuant to § 7-718 of the Village Law of the State of New York and the provisions of the Municipal Home Rule Law of the State of New York, the Village of Hastings-on-Hudson elects to increase the number of members of its Village Planning Board to a total of seven persons.
The Planning Board shall consist of seven members. The first appointment of members thereto shall be for terms so fixed that at least one will expire at the end of each official year commencing at the end of the current such year and continuing in succeeding years until the entire original appointments run out. At the expiration of each original appointment, the succeeding members shall be appointed for terms of five years. No term shall exceed five years. The members of such Board in office at the time this chapter takes effect shall continue in office until the end of the term for which they were appointed and their successors have been appointed as provided in the section and have qualified. If a vacancy shall occur otherwise than by expiration of the term, it shall be filled by appointment for the unexpired term.

This article may be cited as the "Alternate Planning Board Members Act." This article shall apply to the appointment, terms, functions and powers of alternate members appointed to serve on the Planning Board in the Village of Hastings-on-Hudson.
It is sometimes difficult to maintain a quorum on the Planning Board because members are ill, on extended vacation or find they have a conflict of interest situation on a specific matter before such Board. In such instances, official business cannot be conducted, which may delay or impede adherence to required time lines. The use of alternate members in such instances is hereby authorized pursuant to the provisions of this article.
As used in this article, the following terms shall have the meanings indicated:
ALTERNATE MEMBER
An individual appointed by the Village Manager to serve on the Village Planning Board when a regular member is unable to participate on an application or matter before the respective Board, as provided herein.
MEMBER
An individual appointed by the Village Board to serve on the Planning Board pursuant to the provisions of the local law or ordinance which first established such Planning Board.
PLANNING BOARD
The Planning Board of the Village of Hastings-on-Hudson as established by the Village Board of Trustees, by local law or ordinance, pursuant to the provisions of § 7-718 of the Village Law.
A. 
The Village Board of Trustees of the Village of Hastings-on-Hudson hereby enacts this article to provide a process for appointing alternate members to its Planning Board. These individuals would serve when members are absent or unable to participate on an application or matter before the respective Board.
B. 
Alternate members of the Planning Board shall be appointed by the Village Manager, or other duly authorized appointing authority, for a term of five years.
C. 
The Chairperson of the Planning Board may designate an alternate to substitute for a member when such member is unable to participate on an application or matter before the Board. When so designated, the alternate member shall possess all the powers and responsibilities of such member of the Board. Such designation shall be entered into the minutes of the initial Planning Board meeting at which the substitution is made.
D. 
All provisions of state law relating to Planning Board member eligibility, vacancy in office, removal, capability of office and service on other boards, as well as any provisions of a local law/local ordinance relating to training, continuing education, compensation and attendance, shall also apply to alternate members.
This article is hereby adopted pursuant to the provisions of § 10 of the Municipal Home Rule Law and § 10 of the Statute of Local Governments. It is the intent of the Village Board of Trustees, pursuant to § 10 of the Municipal Home Rule Law, to supersede the provisions of § 7-718 of the Village Law relating to the appointment of members to village planning boards.
