The Village of Hewlett Harbor indemnifies and holds harmless each and every elected and appointed official, officer and employee of the Village and shall pay or cause to be paid all reasonable and necessary expenses, including attorney's fees, to defend any such person in any action or proceeding arising out of any act or omission to act in behalf of the Village; provided, however, that this chapter shall not apply with respect to any claim for malpractice and further that the Village shall have no obligation to pay for the defense of any such person charged with a crime or offense or to pay any penalty or fine in connection therewith.
