This chapter, Articles I through VI, shall constitute and be known as the "Sidewalk Code" and may be cited as such and presumptively provides for all matters concerning, affecting or relating to the construction, repair or maintenance of all curbs, gutters, sidewalks and driveways or any other construction in any street between the property line of such street and the curb.
A. 
No curb, gutter, sidewalk or driveway shall be laid in any street in the Village of Valley Stream unless application to lay the same shall have been made in writing to the Village Clerk on blank forms provided by the Village. The application shall specify the location and character of the proposed improvements, and no work shall be done until a written permit, signed by the Commissioner of Public Works, shall be issued on said application.
B. 
All work is to be done in conformity with the specifications prepared by the Village Engineer, under the supervision of the Commissioner of Public Works and approved by the Board of Trustees, which specifications are hereby declared to be a part of this chapter, Articles I through VI.
A. 
All curbs, gutters, sidewalks or driveways shall be laid in accordance with the lines and grades furnished by the Village Engineer and not otherwise.
B. 
It shall be the duty of such person or persons, firm, association or corporation desiring to construct such curb or sidewalk to make a written application therefor to the Board of Trustees of the Village, designating the street, avenue, highway or public place upon which such curb or sidewalk is to be constructed, and to pay a filing fee with such application of the following amounts. These fees may be changed at an open meeting of the Board of Trustees by resolution.

(1) 
Thirty-five dollars upon filing the application with the Board of Trustees.

(2) 
Engineer's fees as follows: a minimum fee of $60 for the first 100 feet or any part thereof of proposed sidewalk or curb which is to be constructed, and $0.60 for each additional foot over 100 feet of proposed sidewalk or curb which is to be constructed.

C. 
In the event that only sidewalk or curb is to be constructed, then these filing fees shall apply to either the sidewalk or the curb which is to be constructed.
D. 
In the event that any person or persons, firm, association or corporation, after paying said fee, shall fail within six months to construct such curb or sidewalk as set forth in the application, such applicant may apply to the Village Clerk of the Village of Valley Stream for a refund of the filing fee, but such applicant shall be entitled only to the difference between the money paid on filing the application and the amount certified to the Village Clerk by the Superintendent of Public Works or Village Engineer or other civil engineer furnishing the grades as representing the fair cost of furnishing such grade.
The work of constructing, repairing or relaying of sidewalks, curbs, driveways or gutters shall be done under the supervision of the Village Engineer of the Department of Public Works, and all materials used and workmanship shall be subject to his inspection and approval.
All sidewalks, curbs, gutters, driveways or pavement laid on any private street or on the streets of any new development shall be subject to the same regulations and must comply in all respects with the regulations governing streets, the title of which is vested in the Village. Failure to comply with the above will be sufficient cause for the Village to reject any preferred dedication of such streets.
All repair or replacement of existing sidewalks, curbs or gutters or driveways shall conform to the regulations hereby established for new construction.
A. 
The grade of the gutters shall be maintained at the grade established by the Village Engineer. No ashes, cinders or other material shall be placed in the roadway in such a manner as to interfere with the proper drainage.
B. 
The grade of the ground adjoining all sidewalks shall on one side be maintained sufficiently low to prevent the collection of water on the sidewalk.
Excavated materials shall be placed as directed by the Village Engineer. If the abutting owner claims the materials, the contractor shall leave them on the abutting property as directed by the owner.
