A.
GARBAGE
PERSON
REFUSE
RUBBISH
In this article, the following words shall have the
meanings hereby respectively ascribed thereto, except where the context
clearly indicates a different meaning:
Animal and vegetable waste resulting from the handling, preparation,
cooking and consumption of foods, and not including more than a minimum
of free liquid.
Any natural person, partnership, association, firm or corporation.
Garbage and/or rubbish as herein defined.
Waste other than garbage, commonly produced or accumulated
in a household or place of business, including but not limited to
paper, posterboard, rags, mattresses, old clothing, glass, crockery,
packing boxes and materials, cans, Christmas trees, leaves, grass
cuttings, pulled weeds and brush, furniture, appliances and other
personalty commonly discarded after the owner thereof has determined
that it is no longer useful and/or desirable; provided, however, that
"rubbish" shall not include industrial refuse, abandoned large machinery
or vehicle, or dead animals.

B.
In this article, the singular shall include the plural,
the plural shall include the singular, and the masculine shall include
the feminine and the neuter.
It shall be unlawful for any person to:
A.
Dispose of refuse by dumping, depositing or storing
the same at any place in the Borough of Leetsdale, whether indoors
or out-of-doors.
B.
Dispose of refuse otherwise than through the Borough's
collection service as set forth and regulated by this article.
C.
Bring into the Borough from outside the Borough limits
any refuse produced or accumulated outside the Borough for disposal
by the Borough's collection service.
D.
Store or accumulate on property owned, occupied or
leased by oneself, any refuse, except while awaiting collection and
removal by the Borough.
A.
Every person owning or occupying premises in the Borough
shall provide and maintain, in good, serviceable condition, containers
for garbage and rubbish as follows:

All garbage shall be drained of liquid and stored
in the container while awaiting collection, and the cover shall be
kept on the container at all times except while being filled and emptied.
The garbage containers shall be stored out-of-doors in a location
convenient for pickup by the Borough collectors.
C.
All rubbish, except as hereinafter otherwise permitted,
shall be stored in the container while awaiting collection. No filled
container shall exceed 75 pounds in weight. The only rubbish that
will be picked up when not in a container shall be: (a) brush, which
must be bundled and tied, such bundles not to exceed four feet in
length; and (b) newspapers, which shall be either bundled and tied,
or boxed. All rubbish shall be placed at the curbline prior to collection.
A.
The Borough of Leetsdale, by and through its employees,
agents or contractors, shall collect, remove and dispose of all garbage,
rubbish and trash for each residential building in the Borough of
Leetsdale containing four or fewer residential dwelling units, at
the curb or accessible alley abutting the property.

B.
Garbage shall be collected once a week from September
15 through June 15 and twice a week from June 16 through September
14. Rubbish shall be collected once a month, with collection to begin
on the first Tuesday after the first Monday of the month and to continue
until all premises in the Borough shall have been serviced. The actual
collection days for properties located on specified streets shall
be determined from time to time and shall be publicized by the Borough
in any manner that it shall see fit. The garbage and rubbish collectors
shall take away and remove all garbage and rubbish containers not
in satisfactory condition, because of leakage or otherwise. It shall
be the responsibility of the owner or occupant of a property, producing
and accumulating garbage and/or rubbish for collection, to clean the
containers after the same shall have been emptied by the Borough employees,
and, in case of rubbish containers, to remove them from the curb prior
to sunset on the day of collection.

Any person who shall violate any provision of
this article shall, upon conviction thereof, be sentenced to pay a
fine not exceeding $600 and costs, or in default of payment thereof,
shall be subject to imprisonment for a term not to exceed 30 days.
Each day that a violation of this article continues shall constitute
a separate offense.

This ordinance superseded former Art. II, Recycling, adopted
5-8-1991 by Ord. No. 494, as amended, and also provided that it should
take effect upon the establishment of the recycling regulations and
after entry into agreements with public or private haulers to collect
recyclables.
The short title of this article shall be the "Borough of Leetsdale
Recycling Ordinance," and the same may be cited in that manner.
The following definitions shall be established as used herein
as follows:
All empty aluminum beverage and food containers.
Empty food or beverage containers consisting of ferrous sides
and bottom and an aluminum top.
Empty steel or tin food or beverage containers.
Bottles and jars made of clear, green or brown glass. Expressly
excluded are noncontainer glass, plate glass, blue glass and porcelain
and ceramic products.
Paper products including paper, newspaper, cardboard and
other paper products.
Empty plastic food and beverage containers. Due to the large
variety of types of plastic, the recycling regulations may stipulate
specific types of plastic which may be recycled.
Those materials specified by the municipality to be recycled.
This list of materials is specified in the recycling regulations resulting
from this article and may be revised from time to time as deemed necessary
by the Borough of Leetsdale.
Any occupied single- or multifamily dwelling having up to
four dwelling units per structure from which a municipal or private
hauler collects solid waste.
All refuse (garbage and rubbish) and other discarded solid
material normally collected by municipal or private hauler.
Prunings, grass clippings, weeds, leaves and garden waste.
There is hereby established a program for the mandatory separation
of recyclable materials from solid waste by all persons within the
Borough of Leetsdale, hereinafter referred to as the "municipality."
Recyclable materials shall be placed at the curb or other collection
site separate from solid waste for collection at such times and dates
as may be hereinafter established by regulation.
It shall be a violation of this article for any person(s), unauthorized
by the municipality, to collect or pick up or cause to be collected
or picked up any such recyclable material. Each such collection in
violation hereof shall constitute a separate and distinct offense
punishable as hereinafter provided.
The Borough of Leetsdale is authorized and directed to enforce
this article. The same is hereby authorized and may establish and
promulgate reasonable regulations as to the manner, days and times
for the collection of recyclable materials in accordance with the
terms hereof and any other matters required to implement this article.
The Borough of Leetsdale may change, modify, repeal or amend any portion
of said rules and regulations at any time.
Any action by any person, firm, corporation or other entity which violates or does not comply with any provision of this article or any regulation thereof shall be punishable by a fine not to exceed $50 upon a first conviction; $100 upon a second conviction; and $300 upon a third or subsequent conviction. The above fines shall not be applicable to a conviction for § 252-10 hereof, which shall be punishable by a fine not to exceed $300. No enforcement of §§ 252-8 and 252-9 of this article shall be made until three months from the effective date of regulations authorized to be promulgated hereunder.
The Borough of Leetsdale may enter into (an) agreement(s) with
public or private agencies or firms to authorize them to collect all
or part of the recyclable materials from curbside or other collection
sites.
It is prohibited and will be deemed a violation hereof for any
owner, lessee or occupant of any residential, commercial or institutional
property in the municipality to put into or cause to be put into the
solid waste collection system of the municipality any leaves or grass
or other yard waste.
