A. 
Whenever any private street, roadway, thoroughfare or sidewalk in the Borough of North Arlington, Bergen County, New Jersey, abuts any premises whereon there is constructed a building or buildings which are occupied either for residential or business purposes, and said private street, roadway, thoroughfare or sidewalk is used as a means of ingress and egress by the occupants of said building or buildings and by members of the public who transact their daily affairs with said occupants, the person, firm or corporation retaining the ownership, control, maintenance or care of said private street, roadway, thoroughfare or sidewalk shall remove, cause to be removed or clean from said private street, roadway, thoroughfare or sidewalk within 12 hours of daylight after the same shall be formed or fall thereon, snow and ice to the extent that said private street, roadway, thoroughfare or sidewalk may be reasonably used by the members of the Police Department and Fire Department of the Borough of North Arlington and their motor vehicle equipment necessary to provide the proper police and fire protection to the persons occupying and the property located on said premises abutting said private street, roadway, thoroughfare or sidewalk.
B. 
Whenever any private street, roadway, thoroughfare or sidewalk in the Borough of North Arlington, Bergen County, abuts any premises wherein there is constructed a building or buildings which are occupied for residential purposes and said street, roadway, thoroughfare or sidewalk is used as a means of ingress and egress by an occupant who is nonambulatory and the person, firm or corporation retaining ownership, control, maintenance or care of said private street, roadway, thoroughfare or sidewalk has been put on notice that said occupant is nonambulatory the person, firm or corporation retaining ownership, control, maintenance or care of said private street, roadway, thoroughfare or sidewalk shall remove, cause to be removed or clear from said private street, roadway, thoroughfare or sidewalk within one hour of daylight after the same shall be formed or fall thereon snow and ice to the extent that the said private street, roadway, thoroughfare or sidewalk may be reasonably used by the members of the Police Department and Fire Department of the Borough of North Arlington and their motor vehicle equipment necessary to provide the proper police and fire protection to the persons occupying and the property located on said premises abutting said private street, roadway, thoroughfare or sidewalk. For the purposes of this section the person, firm or corporation retaining ownership, control, maintenance or care of the private street, roadway, thoroughfare or sidewalk shall be notified that the occupant of its building or buildings is nonambulatory by the mailing of notification by registered or certified mail, return receipt requested, and simultaneously by ordinary mail.

Any person violating or failing to comply with any of the provisions of this article shall, upon conviction thereof, be punishable as provided in Chapter 1, Article I, General Penalty, in the discretion of the court. The continuation of such violation for each successive day shall constitute a separate offense, and the person or persons allowing or permitting the continuation of the violation may be punished as provided above for each separate offense.
