It shall be the duty of the Borough Attorney
to give his opinion, in writing, upon all questions submitted to him
by the Council; to attend all regular meetings of the Council and
all special meetings of the same when requested; to draft all such
resolutions, ordinances, contracts and other papers as may be necessary
for the proper conduct of the public business and the due performance
of the duties of Council; to represent the Council, when requested,
in all matters pending before it and to conduct and conclude negotiations
in the Council's behalf; and to advise the various officers and departments
of the borough as to the proper discharge of the duties devolving
upon them when requested. For all of such services, he shall receive
such salary as the Council may from time to time fix by ordinance
or resolution and, in addition thereto, his actual disbursements made
and expenses incurred in attending to any matters required of him.
The Borough Attorney shall appear for the Mayor
and Council in all litigated matters in which they may be a party
or interested, when required by the Mayor and Council, and shall conduct
all suits, actions and proceedings at law or in equity, prosecuted
or brought by the Mayor and Council for any purpose whatsoever, when
so required by the Mayor and Council, and shall make all necessary
searches and investigations which the Council may from time to time
require. For such services, he shall receive the usual compensation
of attorneys and solicitors for like services or such sum as may be
mutually agreed upon and, in addition thereto, shall receive his actual
disbursements made and expenses incurred in the conduct of such litigation
or investigation and such taxed costs as he may recover from the opposing
litigant.
