The position of Borough Administrator of the
Borough of Rutherford is hereby created, and the employment of a person
to fill such position on a temporary or permanent basis is hereby
authorized.

The Borough Administrator shall have the following
powers and perform the following duties:
A. Shall attend all meetings as directed by the Mayor and Council.
B. Shall provide a liaison between the Mayor and Council and the various
municipal boards, agencies and departments of the Borough of Rutherford
and its professional advisors.
C. Shall keep the Mayor and Council currently informed on all matters
assigned to the administrator or otherwise within the administrator's
jurisdiction.
D. Shall be responsible for the coordination of intradepartmental operations
and manage the day-to-day operations of the Borough Hall by coordinating
and supervising the activities of all employees.
E. Shall make studies and surveys of such municipal problems of the
Borough of Rutherford as shall be assigned from time to time by the
Mayor and Council and prepare and submit written reports of the findings
and determinations to the Mayor and Council for their consideration
and action.
F. Shall have direct responsibility for policy formulation on overall
problems and shall study continually present and future budgets, purchasing
procedures and personnel organization and policies, making appropriate
changes when necessary. The administrator also shall make recommendations
to the Mayor and Council relating thereto as the administrator shall
deem necessary from time to time.
G. Shall be responsible for continually improving communications between
the various Borough personnel, departments, agencies, boards and the
Mayor and Council.
H. Shall see that all terms and conditions imposed in favor of the Borough
or its inhabitants in any statute or contract are faithfully kept
and performed, and, upon knowledge of any violation, call the same
to the attention of the Borough Council.
I. Shall have the authority to recommend the removal, discipline and
appointment of all department heads and all other employees, subject
to personnel policies of the Borough and subject to all rules and
regulations of the New Jersey Department of Civil Service as presently
exist or as may be promulgated in the future. In addition, the administrator
shall have the authority to suspend any and all Borough employees
immediately. In cases of suspension, it shall be the administrator's
responsibility to notify 2/3 of the governing body within 24 hours.
J. Shall continually review and supervise the Borough's insurance program.
K. Shall be responsible for the overall supervision and maintenance
of real property owned by the Borough of Rutherford.
L. Shall act as liaison between the Borough of Rutherford and the various
county, state and federal agencies, with respect to all applications
for funds and/or services needed or required by the Borough of Rutherford.
M. Shall review daily any complaints concerning the functions and obligations
of the Borough of Rutherford made by any of its residents, and shall
have a permanent record of all complaints and the disposition made.
N. Shall make any recommendations which the administrator may believe
will increase the efficiency of the operation of the Borough of Rutherford.
O. Shall prepare and present to the Mayor and Council an annual report
of Borough affairs on or before December 15 of each year, which shall
include a report from each department head.
P. Shall be responsible for the preparation of the operating and capital
improvement budgets for presentation to the Mayor and Council and
for administration of the budget approved by the governing body. In
preparing the proposed budget, the administrator shall alert department
heads to the submission of their portion thereof with supporting data
the administrator deems necessary and shall assist the individual
Council members and department heads in contributing their share of
the responsibility for the municipal budget. The administrator shall
thoroughly review these requests and submit recommendations with respect
thereto to the governing body in a timely fashion.
Q. Shall review all requisitions from departments for materials, equipment
and supplies, and proofs of purchase by the Council. Shall require
the various departments to furnish an adequate inventory of all equipment,
materials and supplies in stock and to recommend the sale of any surplus,
obsolete or unused equipment when authorized by the Mayor and Council.
R. Shall also perform such other duties as may be assigned to the administrator
from time to time by the Mayor and Council.
The Borough Administrator shall furnish a surety
bond to be approved by the Mayor and Council, said bond to be conditioned
upon the faithful performance of his duties. The premium of said bond
shall be paid by the borough.
If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held invalid
or unconstitutional by any court of competent jurisdiction, such portion
shall be deemed a separate, distinct and independent provision and
such holding shall not affect the validity of the remaining portions
hereof.
This ordinance shall take effect immediately
upon publication and final passage pursuant to law.
