The position of Chief Financial Officer of the Borough of Rutherford is hereby created, and the employment of a person to fill such position is hereby authorized.
A. 
Appointment, The Chief Financial Officer shall be appointed by the Mayor with the advice and consent of the Council.
B. 
Term of office. The term of office of the Chief Financial Officer shall be at the pleasure of the Mayor and Council. No Chief Financial Officer shall be removed without being afforded an opportunity to be heard. Unless sooner removed, however, said Chief Financial Officer shall hold office for one year and until his successor shall have qualified.
C. 
Tenure. The Chief Financial Officer may obtain tenure as provided by statute.
D. 
Compensation. The Chief Financial Officer shall receive as salary such sums as may be fixed and adopted by the Salary Ordinance of the Borough of Rutherford.[1]

The Chief Financial Officer shall perform such duties as are required by law and the ordinances of the borough and such duties as may be designated by the Borough Council.
The Chief Financial Officer of the Borough of Rutherford shall furnish a surety bond to be approved by the Mayor and Council, said bond to be conditioned upon the faithful performance of the Chief Financial Officer's duties. The premium of said bond shall be paid by the borough.
If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and such holdings shall not affect the validity of the remaining portions hereof.[1]
