No person shall in any way, or by any means, break, crack, indent, mar, mutilate or otherwise destroy or deface the surface of any public road, street or highway, or the shoulders, curbs or any portion of the right-of-way thereof, within the Township of Shamong.
No person shall place upon, or move along or across the surface of any road, street or highway, within said Township, including the shoulders, curbs and right-of-way thereof, any vehicle, machine, tractor, harrow, farm implement or other chattel having any points, cleats, blocks, hobs, studs or other sharp, rough or hard projection or area in contact with or touching the surface of said road, street or highway or the shoulders or right-of-way thereof, unless said projection or hard area is covered or protected in such a way as to effectively prevent it from marring, marking or damaging the surface of said road, street or highway, or the shoulders, curbs or right-of-way thereof.
Nothing in this article shall be constructed to apply to any person working on, opening or repairing the surface of any road, street or highway pursuant to the authority of the public board or body having control thereof.

Any person or entity who is issued a construction permit, when said construction is located along a street, road or highway which has been accepted as a public street, road or highway by the Township, shall enter into an agreement with the Township at the time of the issuance of the permit, which shall provide that should the person or entity, its employees, contractors, subcontractors, servants, volunteers or agents cause damage, as referenced in § 147-11 above, to any of the streets, roads or highways of the Township during the time they are working on the property for which the construction permit is issued, they shall indemnify and save harmless the Township for the total amount of said damage, including reasonable engineering fees, and, in the event that payment is not made when requested, for all costs and expenses incurred in pursuing the collection thereof, including reasonable attorney's fees.

Any person, firm, corporation, association or legal party whatsoever who or which shall violate, or authorize or procure a violation, or cause to be violated, any provision of this article shall, upon conviction thereof, be punishable as provided in Chapter 1, General Provisions, Article II, General Penalty, § 1-15, governing general penalty provisions.
