For the purpose of this chapter, the following definitions shall apply:
HANDICAPPED PERSON
Any person who has lost the use of one or more limbs as a consequence of paralysis, amputation, or other permanent disability, or who is permanently disabled so as to be unable to walk without the aid of an assisting device or another person assisting them, or whose mobility is otherwise limited as certified by a physician and who has qualified for the issuance of a handicapped person identification card through the Director of the Division of Motor Vehicles in accordance with N.J.S.A. 39:4-205.
PUBLIC BUILDING
Any building, structure, facility, or complex used by the general public, including, but not limited to, theaters, concert halls, auditoriums, museums, schools, libraries, recreation facilities, public transportation terminals and stations, factories, office buildings, business establishments, passenger vehicle service stations, shopping centers, hotels, motels and public eating places. Private residences of less than four units, warehouse storage areas, and buildings containing the manufacturing of hazardous products are specifically excluded from this definition.
A. 
The owners of property upon which new public buildings are proposed to be built shall provide in the plans for the public buildings and the public parking areas serving the public buildings for the creation of parking spaces for handicapped persons in accordance with the provisions and standards set forth in this chapter. No certificate of occupancy shall be issued for said premises unless it meets the standards of and provides for the required parking spaces for handicapped persons.
B. 
All owners of public buildings that are served by parking facilities shall create parking spaces for handicapped persons in accordance with the standards provided in this section and complete the installation of said parking spaces no later than one year from the effective date of this chapter.
A. 
Number of parking spaces required. Parking spaces for handicapped persons shall be constructed according to the following guidelines:[1]

B. 
The location of the parking spaces for handicapped persons shall be in an area of the parking facility which is most accessible and closest to the entrance to the public building that the facility serves. The determination of the location of these spaces shall be made by the Planning Board or the Zoning Board of Adjustment of the Township of Vernon when site plan applications for public buildings are made to these Boards. The Code Enforcement Officer, in conjunction and consultation with the owner of the premises, shall determine the location for these spaces for public buildings that have already been completed. In shopping centers and other multistore facilities, the handicapped spaces shall be as near to the flagship store as possible and/or at such other locations as may be agreed upon between the Code Enforcement Officer and the owner.
C. 
Each space shall be identified with a clearly visible upright sign which has been made according to the specifications and requirements of the Director of the Division of Motor Vehicles, the New Jersey Administrative Code, and New Jersey statutes.
D. 
Each parking space for handicapped persons shall be 12 feet wide to allow additional room for persons in wheelchairs or on braces or crutches to get in or out of either side of the automobile on a level, paved surface suitable for wheeling and walking.
E. 
Where possible, such spaces shall be located so that persons in wheelchairs or using braces or crutches are not compelled to wheel or walk behind parked cars.
F. 
Where applicable, curb ramps shall be provided to permit handicapped people access from the parking area to the sidewalk.
A. 
Any individual or entity that fails to provide parking spaces for handicapped persons as required in this chapter, or who fails to properly maintain said parking spaces so that they are properly marked as parking spaces for handicapped persons, shall be subject to a fine of not more than $50 or imprisonment for a term not exceeding 15 days, or both, or as is otherwise specified in N.J.S.A. 39:4-203.
B. 
Any person who parks, stops or permits a motor vehicles to stand in a parking space designated for handicapped persons, unless the vehicle in that space has affixed to it an identification certificate or marker issued by the Director of the Division of Motor Vehicles of the State of New Jersey as described in N.J.S.A. 39:4-206, is in violation of this chapter. Fines for parking in a handicapped parking space without legal authority from the Director of the Division of Motor Vehicles shall be as follows:

For a first offense: $250.
(2) 
For a second or subsequent offense: $250 and a period of community service not to exceed 90 days.
