[Added 9-10-2008 by Ord. No. 3141]
Bulk refuse, as defined in § 165-18, shall not be placed on curbside of any lands within the Village for collection more than 48 hours prior to the scheduled bulk refuse collection date and time and must be placed in containers consistent with § 165-19C, where applicable, or other approved manner established by the Village Manager.
Where it should be necessary and expedient for the preservation of public health, safety, general welfare or to eliminate a fire or safety hazard, the owner or tenant of any land or premises within the Village shall remove from such land(s) bulk refuse within 24 hours after written notice to remove same is sent to the last known post office address of such owner or tenant by registered mail.
Notice provided by § 165-50 above shall be sent by the Director of the Department of Sanitation or his/her designee, shall describe the articles or matter to be removed, and shall provide an opportunity to such owner or tenant within one day of receipt of such notice to show cause before the officer sending such notice why the removal therein required should not be complied with.
A.
In case any owner or tenant shall fail to remove any such bulk refuse within the twenty-four-hour period after receipt of such notice or within such time as may be granted by the Village official who sent the notice as above provided, then the Department of Sanitation may, on behalf of the Village, cause such premises and land to be entered upon and such articles or matter removed and disposed of as may be necessary or expedient.
B.
Whenever the Director of the Department of Sanitation or his/her designee shall cause the removal of any article or matter pursuant to the provisions of this section, such officer shall certify the cost thereof to the Village Council, which shall examine the certificate and, if found correct, shall cause the cost as shown thereon to be charged against such lands; the amount so charged shall forthwith become a lien upon such lands and shall be added to and become and form part of the taxes next to be assessed and levied upon such lands, the same to bear interest at the same rate as taxes, and shall be collected and enforced by the same officers and in the same manner as taxes.
