Pursuant to § 7-728 of the Village
Law of the State of New York, the Planning Board shall approve, approve
with modifications or disapprove applications for subdivisions. Subdivisions
shall include, but not be limited to, the division of a lot or parcel
into two or more lots or parcels or the conversion to or establishment
of condominiums or cooperatives of any kind.
The Planning Board shall authorize the setting
of a public hearing for the consideration of a subdivision after the
submission of an application on forms prescribed by the Planning Board.
The public hearing shall be advertised at least once in the official
newspaper of the Village, and a notice of hearing shall be posted
in at least three prominent places at least five days before such
hearing.
The contents of the application for a subdivision
shall include, but not be limited to, a recent survey with the seal
of a licensed surveyor embossed on same showing current lot lines,
easements and structures and proposed lot lines, easements and structures,
if applicable. If applicable, a recent licensed architect's rendition
showing existing and/or proposed structures with the architect's seal
affixed.
The approval or the refusal to approve required
by this section shall take place within 62 days after the close of
the public hearing required herein. If no decision is made within
said 62 days, then such subdivision shall be deemed to have been approved
and the Certificate of the Clerk of this Village as to the date of
the close of the public hearing and the failure to take action thereon
within such time shall be issued on demand and shall be sufficient
in lieu of the written endorsement or other evidence of approval herein
required. The ground of refusal of any subdivision shall be stated
upon the records of the Planning Board. An adjournment of the hearing
for any reason shall not constitute a close of the public hearing.
The Planning Board may adopt such rules and
regulations regarding applications for subdivisions as it deems necessary,
consistent with applicable provisions of the Village Law of the State
of New York and this chapter.
Any application for a subdivision shall be referred to the Nassau County Planning Commission as required and in accordance with §
99-2604 of this chapter.
Fees for the application for subdivision approval
before the Planning Board shall be established by the Village Board
by resolution at an open meeting.
