As used in this chapter, the following terms shall have the meanings indicated:
PINBALL OR GAME ROOM
Any public place, building or room where three or more gaming devices, machines or apparatuses are kept for the use, and entertainment of the public; or any place where the purpose of such business is to maintain three or more machines, which, upon insertion of a coin, slug, token, plate or disc, may be operated by the public generally for use as a game or amusement whether or not registering a score and whether its operation demands skill or chance or both. The definition of “game room” shall be limited to those places which derive their principal source of income from such machines.
No person shall keep a billiard table, bagatelle table, pool table, scippio table, or any table of a similar character, in any saloon, shop or place of business within this Town, or own or keep any such table for public use or profit within this Town, or operate a pinball or game room without first obtaining a license from the Town Council; and such Council may grant, with conditions, or refuse to grant such licenses therefor and licenses so granted shall continue for a term not exceeding one year.
Notice of application for a license required by this chapter shall be given to all owners of property within 200 feet of the place of business seeking such application, by mail. Such notice shall be given by the office of the Town Clerk and the cost thereof shall be borne by the applicant. Such notice shall state that remonstrants are entitled to be heard before the granting of such license and shall name the time and place of such hearing.
Operation of an establishment coming under the provisions of this chapter shall be permitted only between the hours of 10:00 a.m. and 10:00 p.m. each day.
The fee for pinball, billiard, bagatelle, pool and scippio tables and game rooms shall be $200 per year for each establishment.
Any person who violates the provisions of this chapter shall be subject to a fine of $20 or be imprisoned not exceeding three months for each offense.
